Frequently cast as a heroic scientist martyred to religion or as a scapegoat of papal politics, Galileo undoubtedly stood at a watershed moment in the political maneuvering of a powerful church. It has come to light ‘scientists using stopwatches’ to document ‘scientific studies’ – now used to justify premature sexual education of elementary school-aged kids, were conducted by child rapists and child murderers. That is one reason statutes should be removed, or extended to the life of the child, or ‘windowed’, since the ‘objective studies’ were done by perps and pervs. Another reason is, the psychiatric record establishes kids, tweens and teens sexually abused often commit suicide or repress the events for 20-30 years in order to not go crazy. They consequently make bad choices and live sad lives that never would have been, if they had not been sexually molested, assaulted, raped, serially raped, gang raped, prostituted and/or ritually abused. Book excerpt: For many the law of the Church, canon law, has little meaning; it appears remote both from the Gospel and from the life of most people in the Church. Yet, it can impinge on them at times if a parish priest urges that a baptism be deferred, where a dispensation is needed for marriage or where there is a query about nullity of marriage. Recently, the scandals over clerical sexual abuse of children have drawn wider attention to the need for law also in the Church. At a time when it is popular to assert 'rights' of all sorts ― an identification of authentic rights and of corresponding duties in the Church, as well as mechanisms to ensure that these are respected in practice in a systematic way ― justice and law in the Church cannot be neglected. This book seeks to root the Church's law in the values of the Gospel, in particular in the justice which should guide the lives of those called to follow Christ and in the baptism by which they are incorporated into him and into his Church. The 'canon' or measure of how we should treat one another as members of the People of God and participate in our common mission in the service of that Gospel, according to our particular vocations and functions, is the focus of canon law. No law can replace the Gospel or the Holy Spirit, but canon law is an instrument of justice in the service of the Church and of its mission. The revision of canon law, which led to the Code of Canon Law of 1983 for the Latin Church, sought expressly to reflect the key teachings of the Second Vatican Council. That Code, beyond the general norms for understanding and applying its laws as a whole, centres upon the People of God in our common, diverse and complementary forms of living the Gospel, upon the Church's broad teaching function, and upon its sanctifying function, especially through the sacraments. It attends also to the temporal goods of the Church, for which there are responsibilities of stewardship, to penal law and sanctions and to procedural law ― the latter designed to ensure that practical implementation of the Church's law which is essential if its affirmations concerning justice and mission are not to remain vacuous. This book attempts to provide a theological and juridical introduction and explanation of these various aspects of the Church's life. The schematic presentation of 'key canons' is designed to enable the reader to understand the principal elements of a specific section and to see how those canons can be broken down so that their inter-related parts may be read, analysed and applied. Book excerpt: Father Ignacio Gordon, SJ, taught canon law (the Catholic Church’s law) from 1960 until 1985 at the Pontifical Gregorian University in Rome, with a concentration on procedural law, or the laws on trials. By all testimonies, he was outstanding for the clarity of his teaching, his humble affection for his students, his indefatigable and hidden service to the Apostolic See, and his priestly zeal. Notable among his endeavors was an educational initiative for the ongoing formation of judges and other ministers of justice in ecclesiastical tribunals. In his teaching, he stressed the ecclesial importance and supernatural implications of procedural law in general, and the indispensability of the judicial protection of marriage in particular. Special efforts were made to make procedural law understandable to his students and to canonists in general, at a time when the Church was celebrating and implementing the teachings of the Second Vatican Ecumenical Council, as a result of which her law was undergoing a major revision. Father Gordon taught from the consistent canonical tradition, while also laying bare the latest developments in law and jurisprudence. He taught the entirety of the law on trials, producing numerous scholarly works on questions both timeless and new, giving marked emphasis to the problem of the excessive length of trials and the causes of delayed justice. An area of his particular attention and dedication was the Supreme Tribunal of the Apostolic Signatura—of which he was a consultor (referendary and later votans)—including both its proper law and its history. This history displayed, in part, why that Tribunal was the natural one to function as the supreme administrative tribunal of the Church. Father Gordon’s contribution to the question of ecclesiastical administrative justice was among those leading the novel and dynamic discussion about it in the 1960s and 1970s.
