Download or read book Blood Land and Sex written by Lyda Favali and published by Indiana University Press. This book was released on 2003-06-18 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Eritrea, state, traditional, and religious laws equally prevail, but any of these legal systems may be put into play depending upon the individual or individuals involved in a legal dispute. Because of conflicting laws, it has been difficult for Eritreans to come to a consensus on what constitutes their legal system. In Blood, Land, and Sex, Lyda Favali and Roy Pateman examine the roles of the state, ethnic groups, religious groups, and the international community in several key areas of Eritrean law -- blood feud or murder, land tenure, gender relations (marriage, prostitution, rape), and female genital surgery. Favali and Pateman explore the intersections of the various laws and discuss how change can be brought to communities where legal ambiguity prevails, often to the grave harm of women and other powerless individuals. This significant book focuses on how Eritrea and other newly emerging democracies might build pluralist legal systems that will be acceptable to an ethnically and religiously diverse population.

Download or read book DOMESTIC VIOLENCE AGAINST WOMEN written by Vitulia Ivone and published by CEDAM. This book was released on 2019-12-05 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Violence against women is one of the most widespread, pervasive and serious violations of human rights affecting every country or area of the globe. Domestic violence against women and girls – commonly known as intimate partner violence or family violence – concerns any form of physical, psychological, sexual, or economic abuse perpetrated by partners and relatives. It encompasses multiple and varied acts and behaviors – ranging from emotional and verbal abuse to femicide – aiming at affirming power and control over women and their lives. Although combating this form of violence is especially challenging in the context of private settings, domestic violence is no longer treated as a “private matter”. Decades of mobilization and sensitization of societies and institutions, strongly supported by the restless action of women’s movements, have contributed to making violence against women a priority on the national and international agendas. Indeed, the road to the adoption of international binding instruments and national legislation on domestic violence has been long and twisted. Nonetheless, today women are protected against violence by some landmark legal instruments adopted at the global, regional and national levels. This book aims to offer a systematic overview of the legal protection afforded to women and girls against domestic violence and other relevant forms of violence and discrimination, while also critically assessing the state of the law at international, regional and domestic levels. Special focus is placed on the European and Italian legal frameworkS.
Download or read book European Family Law Volume II written by Jens M. Scherpe and published by Edward Elgar Publishing. This book was released on 2016-01-29 with total page 417 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Changing Concept of ‘Family’ and Challenges for Domestic Family Law explores the changing concept of ‘family’, with the current social, political, medical and scientific challenges for domestic family law discussed in over 20 European jurisdictions. National reports describe the current law and legal development for ‘horizontal’ (the law of relationships between adults such as marriage, divorce, cohabitation, same-sex relationships), ‘vertical’ (the law governing the relationships between adults and children, such as parentage including artificial reproductive techniques and surrogacy, parental responsibility and adoption) and ‘individual’ (the law of names and recognition of gender identity) family law. They show that, while considerable legal and societal diversity still exists within Europe, family law, in many areas, is developing along similar lines, with a convergence towards a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Book excerpt: Commonly referred to collectively as the anni di piombo -- years of lead -- the 1970s have been seen as a parenthesis in Italian history, which was dominated by political violence and terrorism. The seventeen essays in this wide-ranging collection adopt different scholarly perspectives to challenge this monolithic view and uncover the complexity of the decade, exploring its many facets and re-assessing political conflict. The volume brings to the fore the ruptures of the period through an examination of literature, film, gender relations, party politics and political participation, social structures and identities. This more balanced assessment of the period allows the vibrancy and dynamism of new social and cultural movements to emerge. The long-lasting effects of this period on Italian culture and society and its crucial legacy to the present are lucidly revealed, dispelling the widely-held belief that the 1970s were largely a regressive decade. Furthermore, it investigates those aspects of the new family legal history that have not commonly been examined in depth by legal historians. It presents essays about family and the Christian influence, family and criminal law, family and civil liability, filiation (legitimate, natural and adopted children), and family and children labour law. In addition, it explores specific topics related to marriage, such as the matrimonial property regime from a European comparative perspective, and impediments to marriage, such as bigamy. The book also addresses topics including family, society and European juridical science.

Download or read book Italian Fascism and the Female Body written by Gigliola Gori and published by Routledge. This book was released on 2012-12-06 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first text to examine women and sport in Italy during the period 1861-1945. To qualify and quantify the impact of fascism on Italian Women's sport, the author first of all examines the pre-fascist period in terms of female physical culture. The text then describes how during the fascist era, women moved strictly within a framework designed by medicine and eugenics, religious and traditional education. The country aspired to emancipation, as promised by the fascist revolution but emancipation was hard to advance under the fascist regime because of male hegemonic trends in the country. This book shows how the engagement of women in some sporting activity did promote and support some gender emancipation. The conclusion of the book demonstrates how, in the post-war period, women found it hard to advance further on, for a number of reasons.
Download or read book Les solidarit s entre g n rations written by and published by Primento. This book was released on 2013-03-06 with total page 740 pages. Available in PDF, EPUB and Kindle. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.
Download or read book Recognition of Kafala in the Italian Law System from a Comparative Perspective written by Adele Pastena and published by Cambridge Scholars Publishing. This book was released on 2020-07-09 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: The provision of Islamic kafala has no legal correspondence with secularised political systems and structures, and, as a result, requires a proper understanding of the legislative measures that are indispensable for the protection of the weakest groups of society, at least when the latter turn out to be mostly vulnerable or abandoned. Most recent international conventions have placed much emphasis on the priority to be given to child protection rather than other personal interests. While no syntagmatic principle exists for a theoretical definition and boundary of religious freedoms and legal rules affecting Islamic kafala, it has become a prevailing interpretative canon which requires the scholar to aim for a proper understanding of the cultural identities and measures to safeguard individuals concerned. This book is a thought-provoking study of these important issues, and will serve to strengthen further research into this topic area for the benefit of both academic and professional readers.
