Book excerpt: This book assesses the Statute for a European Cooperative Society (SCE) regarding agricultural activities by comparing how specific questions arising in this context must be dealt with under the Italian and Austrian legal systems. In this regard, Council Regulation (EC) No. 1435/2003, of 22 July 2003, on the Statute for a European Cooperative Society (SCE), is used as a tool for the structured analysis of various aspects of agricultural cooperatives. However, a comparison is only meaningful if the results are made comparable on the basis of a previously defined standard. Accordingly, the study uses, on one hand, a cooperative model developed by European legal scholars that defines general guidelines on how cooperatives should function (PECOL). On the other, the results are presented in connection with economic considerations to discuss how efficient rules can be developed.

While many of his papers dealing with labour relations issues in the Italian context were published in Italian, Marco's long association with Johns Hopkins University and Dickinson College, along with his close links with the leading scholars in comparative labour law and industrial relations not just in the member states of the European Union, but also in many other countries, including Japan, were of fundamental importance for his work, and as a result he chose to publish many of his most thought-provoking papers in English. What emerges from a reading of these papers is the integrity and consistency of his thinking: themes that appear in his early work, such as industrial democracy, employee participation, training for flexibility, the role of small and medium-sized enterprises, and innovative strategies for creating new jobs and improving the quality of work, are further developed in the later years. It is the sheer size and success of these cooperatives that provides practical proof that there is an alternative to private enterprise capitalism namely democratic, collectively owned cooperatives.The main aim of this book is to identify the factors which have enabled cooperatives in Italy to overcome some of the economic and political barriers normally faced by them when competing in Western market economies through an analysis of the relationship that has developed between cooperatives, La Lega and the State.Topics discussed include: an historical overview of cooperative development in Europe and North America; a comparative study of the cooperative sectors in Britain and Mondragon; a discussion on the political and economic barriers faced by cooperatives; an historical analysis of cooperative development in Italy; an explanation of how La Lega operates and how it represents cooperatives' interests in the economic, political and social sphere; original case studies of cooperatives and consortia explain how financial, management and other barriers have been overcome; and, finally, an extensive discussion on the specific character of the Italian State and an explanation of why and when the State is most likely to support cooperatives.
