La materia viene affrontata distinguendo due parti: 1) diritto penale della persona fisica parte generale (soggetti attivi e delega di funzioni, regole cautelari, nesso di causali tà e profili della colpa, delitti di comune pericolo - astratto e concreto -, sanzioni e contravvenzioni; effetti di diritto penale sostanziale derivanti dalla eventuale istituzione di una Procura nazionale del lavoro) parte speciale (obbligo sicuritario nel contesto lavorativo, influenza del delitto di caporalato sulle morti o lesioni causate da incidenti sul lavoro, rimozione od omissione dolosa o colposa di cautele o difese contro disastri o infortuni sul lavoro). 2) diritto punitivo della persona giuridica (profili, sia di diritto sostanziale sia di diritto processuale, della normativa sulla responsabilità da reato degli enti). Il datore di lavoro, affiancato da altre figure specifiche, titolari anch’esse di obblighi normativamente codificati, deve preliminarmente analizzare e studiare l'organizzazione del luogo di lavoro, per individuare e valutare tutti i rischi aziendali, e poi formare e informare adeguatamente i lavoratori. Conseguenza ne è che la violazione delle norme poste a presidio dei doveri di prevenzione genera la responsabilità penale.

La disciplina realizza nel presente l’intersezione, sostanzialmente armoniosa, tra il nuovo tracciato, segnato dalla gestione organizzata, autonormata, multilivello del rischio, che caratterizza la legislazione più recente; e gli antichi sentieri, definiti dalla regolamentazione rigida, analitica, tassativa originatasi negli anni Cinquanta dello scorso secolo. Il libro si propone di cogliere le movenze di tale sviluppo; e di offrire un quadro aggiornato del composito sistema di governo del rischio lavorativo. La materia è stata intensamente coinvolta nella prassi. Si è trattato di valutare eventi drammatici e talvolta disastrosi, spesso determinati dal contatto delle vittime con sostanze dalle caratteristiche poco note. Questi scenari hanno suscitato interrogativi nuovi e difficili. Ne è nato un forte stimolo alla riflessione teorica e giurisprudenziale, che ha inciso sulla dogmatica penale: figure come la causalità, la posizione di garanzia e la colpa sono state incisivamente rimodellate proprio nel contesto della sicurezza del lavoro. Il volume è in larga parte dedicato alla ricostruzione del nuovo volto assunto da tali fondamentali categorie. Esso, inoltre, analizza il tema del sapere scientifico e dei ragionamenti probatori che ne fanno uso, che – pure – ha assunto nuovo, vitale interesse nei giudizi relativi alle esposizioni lavorative a sostanze dannose. Un capitolo è infine dedicato alla disciplina della responsabilità dell’ente per i reati di omicidio e lesioni personali nel contesto lavorativo. Lo studio si propone di elaborare una ricostruzione organica e, per quanto possibile, semplice della dogmatica della materia, percorsa da incertezze che ne ostacolano l’applicazione. L’accoglienza ricevuta dal lavoro ha incoraggiato la seconda edizione riveduta ed ampliata anche alla luce delle novità normative e giurisprudenziali.
