Book Redefining Organised Crime A Challenge for the European Union

Download or read book Redefining Organised Crime A Challenge for the European Union written by Stefania Carnevale and published by Bloomsbury Publishing. This book was released on 2017-12-28 with total page 607 pages. Available in PDF, EPUB and Kindle. Book excerpt: The definition of organised crime has long been the object of lively debate, at national and international level. Sociological and legal analysis has not yet led to one definitive answer to the question of what exactly 'organised crime' means. Nonetheless, many instruments adopted both at international and national levels set forth special legal regimes designed to target criminal groups featuring a stable organisation, which are perceived as particularly dangerous to society. Therefore, identifying the notion of organised crime is crucial to establishing the scope of any legal instrument specifically designed for combating it. The aim of this book is to reassess the scope, the effectiveness and the overall coherence of existing definitions of organised crime, and to identify any need for a reconsideration of these definitions, specifically with reference to the EU legal order. It will be of interest to academics, practitioners and legislators working in the sphere of EU criminal law and of organised crime more generally.

Academics and researchers, as well as the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative criminal law.

Book The Crime of Conspiracy in International Criminal Law

Download or read book The Crime of Conspiracy in International Criminal Law written by Juliet R. Amenge Okoth and published by Springer. This book was released on 2014-05-13 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the relevance of conspiracy in international criminal law. It establishes that conspiracy was introduced into international criminal law for purposes of prevention and to combat the collective nature of participation in commission of international crimes. Its use as a tool of accountability has, however, been affected by conflicting conceptual perceptions of conspiracy from common law and civil law countries. This conflict is displayed in the decisions on conspiracy by the international criminal tribunals, and finally culminates into the exclusion of punishment of conspiracy in the Rome Statute. It is questionable whether this latest development on the law of conspiracy was a prudent decision. While the function of conspiracy as a mode of liability is satisfactorily covered by the modes of participation in the Rome Statute, its function as a purely inchoate crime used to punish incomplete crimes is missing. This book creates a case for inclusion in the Rome Statute, punishment of conspiracies involving international crimes that do not extend beyond the conceptual stage, to reinforce the Statute’s purpose of prevention. The conspiracy concept proposed is one that reflects the characteristics acceptable under both common law and civil law systems.

Book excerpt: The Roman army represented an important social and organizational reference model for the Romano-Barbarian societies, which progressively replaced the Western Empire in the transition from Late Antiquity to Early Middle Ages. Book Jurists and Jurisprudence in Medieval Italy

Download or read book Jurists and Jurisprudence in Medieval Italy written by Osvaldo Cavallar and published by University of Toronto Press. This book was released on 2020-10-01 with total page 894 pages. Available in PDF, EPUB and Kindle. Book excerpt: Jurists and Jurisprudence in Medieval Italy is an original collection of texts exemplifying medieval Italian jurisprudence, known as the ius commune. Translated for the first time into English, many of the texts exist only in early printed editions and manuscripts. Featuring commentaries by leading medieval civil law jurists, notably Azo Portius, Accursius, Albertus Gandinus, Bartolus of Sassoferrato, and Baldus de Ubaldis, this book covers a wide range of topics, including how to teach and study law, the production of legal texts, the ethical norms guiding practitioners, civil and criminal procedures, and family matters. The translations, together with context-setting introductions, highlight fundamental legal concepts and practices and the milieu in which jurists operated. They offer entry points for exploring perennial subjects such as the professionalization of lawyers, the tangled relationship between law and morality, the role of gender in the socio-legal order, and the extent to which the ius commune can be considered an autonomous system of law.

Book Command Responsibility in International Criminal Law

Download or read book Command Responsibility in International Criminal Law written by Chantal Meloni and published by Asser Press. This book was released on 2010-06-10 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers an in-depth study of the command responsibility doctrine, pursuant to which military commanders and civilian leaders can be held responsible for the crimes committed by their subordinates that they failed to prevent or punish. This form of responsibility has gained much attention in the last years; however, it still presents several open questions and critical difficulties arise in its application. The author traces the roots of such criminal responsibility, from its military origins to its first appearances in international case law after World War II. Particular attention is given to the jurisprudence of the ad hoc Tribunals, which extensively elaborated on the issue, and to the provision of Article 28 of the Statute of the International Criminal Court. The book provides a systematic analysis of command responsibility, outlining its different forms and finding a proper role for it within the complex net of responsibilities that connotes the commission of international crimes. This book is an important contribution to the literature and worldwide discussion on command responsibility and therefore highly recommended to scholars of international law, criminal law and international criminal law as well as to all practitioners (judges, legal assistants, prosecutors, defence counsels) working at or with international tribunals, experts in the military field, investigators dealing with international crimes, NGOs and journalists. Chantal Meloni is working as a Researcher at the Criminal Law Department of the UniversitàdegliStudi of Milan, Italy. Since several years she specializes in international criminal law. She spent long research periods abroad, in particular at the Humboldt Universität of Berlin in Germany. She also worked at the International Criminal Court as a Legal Assistant in Chambers.

Available in PDF, EPUB and Kindle. Book excerpt: Stories of transnational terror and justice illuminate the past and present of South America's struggles for human rights "Outstanding. . . . An Olympian view of the Condor system."--Philip Chrimes, International Affairs Through the voices of survivors and witnesses, human rights activists, judicial actors, journalists, and historians, Francesca Lessa unravels the secrets of transnational repression masterminded by South American dictators between 1969 and 1981. Under Operation Condor, their violent and oppressive regimes kidnapped, tortured, and murdered hundreds of exiles, or forcibly returned them to the countries from which they had fled. South America became a zone of terror for those who were targeted, and of impunity for those who perpetuated the violence. Lessa shows how networks of justice seekers gradually materialized and effectively transcended national borders to achieve justice for the victims of these horrors. Based on extensive fieldwork, archival research, trial ethnography, and over one hundred interviews, The Condor Trials explores South America's past and present and sheds light on ongoing struggles for justice as its societies come to terms with the unparalleled atrocities of their not-so-distant pasts.
