The strategies of intervention mapped out in international programmes (gender mainstreaming and empowerment) underscore the commitment and the responsibilities of educational processes. The aim of the book is to stimulate reflection on the role of education in the establishment of gender identities and in fostering the human rights of women in contemporary society. With a view to an interdisciplinary feminist and feminine analysis, which is essential to the development and interweaving of gender issues and points of educational interest, the question is posed as to whether a new sensitivity and a more widespread gender culture could successfully trigger daily practices of gender-oriented education.

La seconda offre materiali di base per l’alta formazione negli studi di genere: i saggi di Yan Thomas ed Ernst Holthöfer – tradotti per la prima volta in Italia – costituiscono un punto di riferimento teorico e una chiave interpretativa essenziale nel dibattito sulle identità di genere, sui problemi della soggettività e sulle relazioni di potere nei vari contesti storici. Yan Thomas spiega come il corpo di una donna, o meglio di una madre, si possa convertire nel corpo del nascituro, e cioè come attraverso il diritto una natura fisica si trasformi in una natura giuridica dotata di effettività. Secondo il diritto romano classico infatti il nascituro è immediatamente dotato di diritti poiché in caso di morte del padre la sua presenza blocca e muta le decisioni di un testamento. La donna si trova in questo caso «nella curiosa situazione di incarnare un lignaggio maschile poiché è una sola cosa col ventre». La si può considerare cioè «come ciò che non è lei». Ma una identità sottoposta a tali profondi cambiamenti provocherà certamente importanti ricadute sulla complessità delle relazioni di potere e lascerà emergere il significato e le possibilità offerti dalle contraddizioni tra le norme non solo nel contesto del diritto romano classico. Nella storia del diritto privato e soprattutto dei diritti di famiglia sono state infatti proprio le incoerenze profonde degli apparati normativi a permettere di intervenire sull’uso dei vari istituti giuridici riguardanti le disuguaglianze tra uomini e donne, influenzandone a volte adattamenti e trasformazioni. È quanto emerge dall’ampio saggio di Holthöfer sulla cura sexus in Europa dal diritto romano antico alle grandi codificazioni liberali tra Settecento e Ottocento.
