Book excerpt: About the publication This volume of essays, A life interrupted: essays in honour of the lives and legacies of Christof Heyns, honours Christof Heyns, renowned human rights lawyer, advocate, activist and educator, but also down-to-earth family man, friend and colleague. Christof’s sudden and most untimely passing on 28 March 2021 deeply saddened those close to him but also evinced an outpouring of grief from the national and international human rights community. His passing brought a deep sense of loss, in part because, at age 62, he was fully engaged in contributing to the betterment of society and still had so much more to give. His is a life interrupted. But at the same time, looking back over the varied lives he lived, he had already left his mark in so many ways. His influences and impacts are manifold and magical. This collection not only testifies to the legacy that he has left us, but also to the ongoing efforts of many to continue building on his legacy. This collection contains two sets of essays by family members, friends, colleagues, collaborators and students. Part A contains essays of a more reflective and personal nature, while the contributions in Part B link to the scholarly or academic themes Christof had worked on and explored, including international human rights systems, international law, the right to life, freedom of association, international humanitarian law, the impact of human rights treaties, constitutionalism and legal philosophy. However, a neat distinction between the personal and professional is not possible in respect of such a warm, generous and enthusiastic person as Christof. Most of the essays in Part A integrate some of Christof’s professional and academic achievements, while many of the essays in Part B also reflect on Christof as a person. The editors, all based at the Faculty of Law, UP, are colleagues and friends who worked closely with Christof. Frans Viljoen succeeded Christof as Director of the Centre for Human Rights. Christof was his doctoral supervisor, mentor and research collaborator. Charles Fombad worked with Christof at ICLA, and took over as ICLA Director after Christof’s passing. Dire Tladi, an ICLA fellow, had his office just across from Christof in ICLA. As member of the International Law Commission, he shared with Christof high level engagement with the UN. While Christof served on the Human Rights Committee, his colleague Ann Skelton serves on the Committee on the Rights of the Child. Magnus Killander worked closely with Christof as co-author and co-editor. Christof was also his doctoral supervisor. The publication date of this book is 10 January 2022, which is the date marking 63 years since Christof’s birth. The publisher is the Pretoria University Law Press (PULP), of which Christof was also a founder.

Book excerpt: Global systemically important banks (G-SIBs) are the largest, most complex and, in the event of their potential failure, most threatening banking institutions in the world. The Global Financial Crisis (GFC) was a turning point for G-SIBs, many of which contributed to the outbreak and severity of this downturn. The unfolding of the GFC also revealed flaws and omissions in the legal framework applying to financial entities. In the context of G-SIBs, it clearly demonstrated that the legal regimes, both in the USA and in the EU, grossly ignored the specific character of these institutions and their systemic importance, complexity, and individualism. As a result of this omission, these megabanks were long treated like any other smaller banking institutions. Since the GFC, legal systems have changed a lot on both sides of the Atlantic, and global and national lawmakers have adopted new rules applying specifically to G-SIBs to reduce their threat to financial stability. This book explores whether the G-SIB-specific regulatory frameworks are adequately tailored to their individualism in order to prevent them from exploiting overly general rules, as they did during the GFC. Analyzing the specific character and individualism of G-SIBs, in relation to their history, normal functioning, as well as their operations during the GFC, this book discusses transformation of banking systems and the challenges and opportunities G-SIBs face, such as Big Tech competitors, climate-related requirements, and the COVID-19 pandemic. Taking a multidisciplinary approach which combines financial aspects of operations of G- SIBs and legal analysis, the book describes G-SIB-oriented legal frameworks of the EU and the USA and assesses whether G-SIB individualism is adequately reflected, analyzing trends in supervisory action when it comes to discretion in the G-SIB context, all in order to contribute to the ongoing discussions about international banking law, its problems, and potential remedies to such persistent flaws.

Peace activists in the 1980s did not know that Margaret Thatcher's government feared that US troops on UK bases would fire on unarmed demonstrators. While the jingoistic atmosphere of the Falklands War is much remembered, there is less talk about the protests against it that saw more than 100 arrests at navy recruitment centres and public demonstrations. Four women who successfully disarmed a warplane in the 1990s were just a few of those to be acquitted after actions that could have resulted in years in prison. Apparent public support for the campaign against the Iraq war masked deep and bitter divisions amongst anti-war activists. Dissent and disobedience within the armed forces continues far from the public gaze. As recently as 2011, Michael Lyons was refused discharge from the Royal Navy despite developing a conscientious objection to war. He spent seven months in a military prison. Book excerpt: Drawing on data from five rounds of the Myanmar Household Welfare Survey (MHWS) collected between December 2021 and June 2023 with more than 12,000 respondents per round, this report analyzes individual migration, migration in which one or a few household members leave the household. To complement this analysis, we utilize data from the Myanmar Migration Assessment, carried out in June and July 2023 in a sub-sample of MHWS households with household members who have migrated since 2013. Over the year and a half period, from December 2021 to June 2023 an estimated 6,451,394 household members 15 and older, 11.8 percent of the population and 19.9 percent of the adult population, left their households. Kayah had the highest percentage of migrants, followed by Kachin, Kayin, and Mon, with migration rates over 25 percent of the adult population. Significantly more men migrated than women. Over the period, more individuals left for work within Myanmar than for overseas work or for other reasons including marriage, education, or to join family. Using the Myanmar Migration Assessment sub-sample of 5,455 of individuals who have migrated since 2013, we analyze the migration process and destination characteristics. Most migrants in our sample only migrated once, 91 percent. Between 2021 and 2022, there was a huge jump in migration from 10 percent of the sample to 24 percent. Further, migration was already 23 percent of our sample in June 2023. Therefore, individual migration is likely to be much higher in 2023 than 2022. Between 2021 and 2023, most of the individual migration was internal, 79 percent versus 21 percent overseas. Internal migration and migration abroad are increasing at the same rate. Most internal migration was to Yangon, followed by Mandalay, and Shan. Around 27 percent of all individuals migrated to Yangon over the whole period. Migration to Mandalay decreased from 2010 to 2023, while migration to Shan increased. Migration abroad is mainly to Thailand and Malaysia. Most individuals migrated to find better employment. Employment was the most important driver of migration across all years, all destinations, all age groups, and for men and women. In 2021-2023, 34 percent of individuals left their homes to find more work opportunities, 18 percent left their home to find a higher paid job, and 7 percent left to find better working conditions. At the same time, an increasing number of individuals migrated for education, as well. In 2021-2023, 12 percent of migrants were household heads, most other migrants were either sons or daughters of the head. While between 2013 and 2016 only 44 percent of migrants had children when they migrated, in 2021-2023, 91 percent of migrants had children before they migrated. Overall, most migrants, regardless of their primary reason for migrating, had friends or relatives who had migrated to their destination before them, this includes 55 percent of internal migrants, and 58 percent of migrants abroad. Most migrants participated in most or all of the decisions to migrate. This was true for 85 percent of migrants that went abroad and 79 percent of migrants that remained within Myanmar. In Mandalay and Shan, fewer migrants fully participated in the decision to migrate.
