Book excerpt: I numerosi provvedimenti legislativi emanati nel corso degli ultimi anni in materia di apprendistato ed, in generale, di contratti a contenuto formativo evidenziano tutta la difficoltà incontrata dal legislatore nel disegnare e rendere operativi adeguati strumenti contrattuali rivolti alla promozione della formazione professionale, in vista dell’inserimento dei giovani nel mercato del lavoro. La riforma Fornero del 2012 è intervenuta nuovamente, a distanza di poco meno di un anno, su un istituto – l’apprendistato – che si credeva fosse stato rivisitato in modo organico ed esaustivo ad opera del d.lgs. 14 settembre 2011, n. 167 (“Testo Unico dell’apprendistato”): le novità, per quanto circoscritte, incidono su specifici punti della disciplina comune alle diverse tipologie di apprendistato, introducendo elementi di tutela e misure promozionali. Al contempo, la riforma Fornero abolisce l’istituto del contratto di inserimento e detta le linee guida in materia di tirocini formativi e di orientamento. Il risultato è quello di un articolato e caotico complesso normativo, ove si intrecciano, a vario titolo, legislazione statale, legislazione regionale e contrattazione collettiva. La guida fornisce una panoramica quanto più completa ed esaustiva della regolamentazione dei contratti a contenuto formativo, in particolare in tema di: - disciplina comune del contratto di apprendistato; - caratteri e peculiarità delle diverse tipologie di apprendistato; - standard formativi, standard professionali e certificazione delle competenze; - tirocini formativi e di orientamento (c.d. stages). Il testo è aggiornato ai più recenti interpelli ministeriali ed alla Circolare INPS n. 128 del 2 novembre 2012 (contenente indicazioni su aspetti normativi e contributivi in tema di apprendistato). L’opera intende fornire agli addetti ai lavori chiarimenti, commenti e risposte a quesiti pratici, grazie all’ausilio di schemi, tabelle riepilogative, formule e modelli.
