Book excerpt: Focusing on East Asia, this collection explores the paradox of functional regional cooperation in the areas of humanitarian assistance, disaster relief, and UN Peacekeeping operations, in a context of increasing regional tensions and threats. East Asia – comprising the states of the Association of Southeast Asian Nations and China, Japan, the Republic of Korea and the Democratic People’s Republic of Korea – is facing a range of human, traditional, climate and ideational threats. In addressing some of these threats particularly those arising from climate induced disasters this region has been able to develop some ad-hoc cooperative practices that, according to functional logics of regional integration, could lead to longer term sustained coordinated responses and even regional partnerships. Similarly, the region is increasingly contributing to UN peacekeeping operations where these states also cooperate in the context of an UN-led mission. Yet, despite the potential for these interactions to lead to greater regional integration and coordinated action in responding to a range of security threats, these interactions are increasingly taking place in a context of animosity both between regional powers and with extra-regional powers. This edited collection explores these functional interactions and posits conclusions about the potential for longer term sustained coordinated action. These papers engage with a range of theoretical approaches in explaining the patterns of relations that are present in the region in relation to humanitarian assistance, disaster relief, and UN peacekeeping operations. The chapters in this book were originally published as a special issue of the Australian Journal of International Affairs.

Since the end of the Cold War, the number and complexity of UN peacekeeping operations have increased dramatically due to profound changes in many areas of the world. The recent trend has seen a shift from inter-state to intra-state conflicts, bringing in its wake a myriad of operational, legal and political questions, such as the very relevance and applicability of the principle of non-interference in the internal affairs of the state. Parties to recent conflicts have no central authority and little or no regard for international humanitarian law. Interested and involved parties on the peacekeeping and humanitarian scene have also changed and multiplied. All these factors render humanitarian action more complex, dangerous and difficult for all parties involved. The book reviews four United Nations peacekeeping operations that have undergone immense difficulties, viz. in Somalia, the former Yugoslavia, Rwanda and Liberia. It debates the pertinent political framework for humanitarian action in each case. It explores the relationship between humanitarian and military action, of coordination with regional organizations and multinational force, as well as fundamental questions regarding the role and responsibility of the member states of the Security Council. Its findings can provide policy-makers, researchers and analysts of international affairs with a sober and thorough assessment of past experience and lessons for the future.

At a time when the mandate of many peace support operations includes halting violations of international humanitarian law by third parties, there is still a lack of clarity concerning accountability of peace support operations themselves. This book addresses that accountability, focusing on peace support operations under the command and control of the United Nations and the North Atlantic Treaty Organization. It is concerned with the accountability of international organizations as well as troops contributing and member states, but not of individuals. Drawing on existing and emerging doctrines of international law, including the law of state responsibility, the law of responsibility of international organizations, international institutional law and international humanitarian law, and on the basis of state practice, this book makes a strong plea for improving mechanisms to implement the accountability of peace support operations under international humanitarian law.
