Book excerpt: Excerpt from Housing by Employers in the United States "Employers' housing" is the term used to describe housing work done by employers in the interest of their employees. It is synonymous with the term "company housing." The housing work must be incidental to the main business of the employer. The employer's interest in the housing work must be that of an employer, and not primarily that of a real estate operator or builder. The employer may carry on the housing work as an integral part of his main business, or through a subsidiary company or other secondary means; he may provide the capital for building or merely furnish the land. The fact that an employer houses only a small fraction of his employees or only a certain limited class is not a test as to whether or not any particular scheme is an employers' housing scheme; neither is the amount of profits from the scheme a test. Further, the mere name of the company which does the housing work for the employer is not a criterion of the bona fide character of such work as an employers' housing scheme. Company housing is as old as the industrial history of the United States. When industry passed from the home to the factory, company housing became necessary, since the colonial manufacturer was a pioneer who opened up new sites for factories at those points generally where water power was available. How great is the need? The United States Senate answers, reporting that 13,200,000 new dwelling units must be built by 1945. That requires an average construction of 1,320,000 new houses and apartments each year for the next 10 years. What is being done? The Bureau of Labor Statistics says that in 257 typical cities surveyed only 22,063 new homes were built in 1934. In the more normal year of 1925 only 491,222 homes were completed in these cities. Therefore, even if the private construction industry comes back to pre-depression full strength, it will be able to meet less than half of the need. What will happen to wage earners? Even if this enormous deficit in all kinds of housing were made up, past experience suggests that unless some new techniques are developed little or none of the new construction will be of the kind which low-income families can afford. Unless we very quickly change our habits of thought and action about housing, workers will have to remain content with the cast-off, frequently worn out, almost always deficient houses discarded by other sections of our population. "Homes for Workers" is a simple statement of the housing situation which confronts American workers and their Governments - Federal, State and Municipal. Yet it is a limitation upon governmental action which the state must observe and the courts enforce. Its obvious purpose is the protection of private rights against governmental inter ference except Where made in the furtherance of the legitimate purposes of government. But what are the legitimate purposes of government? They must be ascertained by reference to the legal and governmental theories current when the due process provisions were written into our fundamental law. Most of the at tempts to define conclusively the police power have in fact been efforts to state or summarize these purposes. It is frequently defined as a power to regulate private rights in the interest of the public health, morals, safety, peace, and welfare. The supreme court of the United States has declared that neither the amend ment (the fourteenth amendment) - broad and com prehensive as it is - nor any other amendment, was designed to interfere with the power of the state, sometimes termed its police power, to prescribe regula tions to promote the health, peace, morals, education, and good order of the people, and to legislate so as to increase the industries of the state, develop its resources, and add to its wealth and prosperity - Barbier V. Connolly, 113 U. S. 27. This is generally regarded as a satisfactory summary of the legitimate functions of government, though it is by no means clear that a care ful study of our legal and governmental history might not disclose other functions such as the power to protect those economically weak from the aggression of the strong. The existence of such power seems to be evi denced by the presence of usury and other like laws in our legal history.
