Book excerpt: Excerpt from The Case of the Pious Fund of the Californias: United States of America Vs; Republic of Mexico Even if no perfect right had existed in the Catholic Church of Upper California to administer the Pious Fund of the Californias, or to demand the perpetual interest thereon provided for by the Mexican decrees (a proposition we deny), nevertheless, in the eye of a court of equity dealing with the subject matter upon broad principles of right, the Catholic Church, through its accredited officers, would have been the proper recipient of the interest upon the fund. And this equitable, and, as we contend legal, right also, was conclusively recognized by the Mexican Government, as has been fully discussed in the brief of the Agent and Counsel of the United States, pages 55 and 56. For further considerations relative to the question of legal right, we also refer to the argument of Messrs. Stewart and Kappler. III. (A). For the moment, under this heading, following the answer of Mexico, attention is invited to the fact that Sr. Mariscal in his statement in the answer of the trusts upon which the Pious Fund was held only included them in so far as he esteemed them as assisting to sustain the argument he desired to make. We have not believed that the court could be enlightened or brought to a proper conclusion by this method of treatment, and in the original brief, we have fully stated the trusts, and, for the convenience of the Court, we have repeated them in a foot-note to the English copy of the answer. (See Exhibit A hereto attached.) In the American view of the matter, a proper conclusion as to the meaning of the instrument in question can only be gained by a perusal of its essential parts, and any argument predicated upon partial and imperfect quotation must be erroneous in itself, and incidentally have a tendency to mislead the court. I wrote him, pointing out some difficulties which arose from the wording of our former contract, and which I wished settled first and leaving the settlement to him, so it was not until 1884 when he renewed his request for further efforts in the Pious Fund case, and I again insisted on his deciding the unsettled question mentioned in my letter in 1883, that he gave me an answer, and thereupon engaged me for such further effort. It was agreed that the compensation of myself and my associate, whom I was to select myself, was to be the same as in the former case, viz: 25 per cent of all collected, and that the clause about disbursements which had led to a little difference in the former case should be slightly changed. The salaries and supplies, and the sources from which the necessary funds were to be drawn, were personally arranged by Galvez with all the exactness of a modern municipal budget. His methods were new in Mexico, but the despotic energy of the Visitor made them be observed punctually. He made no scruple about using the capital of the Pious Fund for the expenses of the first expedition. The surplus in the hands of the last Jesuit procurator and the stores in the magazine at Loretto amounted to nearly two hundred thousand dollars, and were all employed in building the ships and furnishing supplies for the royal expedition. Galvez was strict in the matter of economy. He reduced the pay hitherto al lowed by the treasury to soldiers on California service, and he made up the church furniture and altar linen for the new missions by borrowing from those already founded on the peninsula. Father Palou incidentally mentions that many of the latter were almost worn out when sent. In vindication of his colleagues against the insinuations of Sergeant Barri on this head, the worthy Franciscan appealed to the wife of a Spanish sergeant, who had to mend, wash and iron the albs and altar linen before they could be shipped to Monterey.
