Book excerpt: Excerpt from History of the Law of Nations in Europe and America, From the Earliest Times to the Treaty of Washington, 1842 This work was originally written and published in the French language as a Memoire in answer to the following prize question proposed by the Academy of Moral and Political Sciences in the Institute of France: "Quels sont les progres qu'a fait le droit des gens en Europe depuis la Paix de Westphalie?" In rendering it into our language the author has considerably enlarged the work, especially the introductory part relating to the history of the European law of nations previous to the peace of Westphalia. He has also subjoined a summary account of the international relations of the Ottoman Empire with the other European states, of the recent transactions relating to the interference of the great powers in the affairs of Greece and Egypt, and of the discussions between the United States and Great Britain, relating to the right of search as applicable to the African slave trade, terminated by the treaty of Washington in 1842. Book The Law of Nations in Early American Foreign Policy

Download or read book The Law of Nations in Early American Foreign Policy written by Willem Theo Oosterveld and published by BRILL. This book was released on 2016-01-12 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Law of Nations in Early American Foreign Policy, Willem Theo Oosterveld provides the first general study of international law as interpreted and applied by the generation of the Founding Fathers. A mostly neglected aspect in the historiography of the early republic, this study argues that international law was in fact an integral part of the Revolutionary creed. Taking the reader from colonial debates about the law of nations to the discussions about slavery in the early 19th century, this study shows the zest of the Founders to conduct foreign policy on the basis of treatises such as Vattel’s The Law of Nations. But it also highlights the deep ambiguities and sometimes personal struggles that arose when applying international law.

Book American Pentimento

Download or read book American Pentimento written by Patricia Seed and published by U of Minnesota Press. This book was released on 2001 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The modern regulations and pervading attitudes that control native rights in the Americas may appear unrelated to the European colonial rule, but traces of the colonizers' cultural, religious, and economic agendas remain. Patricia Seed likens this situation to a pentimento - a painting in which traces of older compositions become visible over time -and shows how the exploitation begun centuries ago continues today. Seed examines how the goals of European colonialist in the Americas. The English appropriated land, while the Spanish and Portuguese attempted to eliminate "barbarous" religious behavior and used indigenous labor to take mineral resources. Ultimately, each approach denied native people distinct aspects of their heritage. Seed argues that their differing effects persist, with natives in former English colonies fighting for land rights, while those in former Spanish and Portuguese colonies fight for human dignity." -- Book jacket.

Book Cornelius van Bynkershoek His Role in the History of International Law

Download or read book Cornelius van Bynkershoek His Role in the History of International Law written by Kinji Akashi and published by BRILL. This book was released on 2024-01-15 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: In offering a critical analysis of the writings of Cornelius van Bynkershoek (1673-1743) - the eminent Dutch jurist known traditionally as a `positivist', in the history of international law - this work goes beyond an analysis of the `classics' per se to clarify some basic questions concerning the history of international law, such as the relationship between legal doctrine and state practice and the reconsideration of methodological differences among historical figures like Grotius, Pufendorf, and Vattel. It also covers some fundamental problems of international law generally, such as the meaning of positivism and positive law and the function of reason. The work comprises three main parts: - the construction of Van Bynkershoek's general theory of the law of nations, - an overview and analysis of the contemporary practice relevant to his theories on the laws of neutral commerce, and - the 'genealogy' of Van Bynkershoek's works, namely his relation to Grotius and to his later generations of publicists. Scholars and others interested in the past and future direction of international law as a whole will not want to miss this highly original offering.
