In 1536, the Portuguese Inquisition was established, ending in 1821. In 2015, Portugal offered dual nationality to Jews who had a connection to the country, with a path to citizenship. Portuguese requirements for citizenship differed significantly from a similar offer by Spain, making the Portuguese pathway, simpler and less complicated. Douglas Husak argues in favor of drug decriminalization, by clarifying the meaning of crucial terms, such as legalize, decriminalize, and drugs; and by identifying the standards by which alternative drug policies should be assessed. He critically examines the reasons typically offered in favor of our current approach and explains why decriminalization is preferable. Therefore, many legal subjects have to enter into the precontractual phase of negotiations that eventually lead to a conclusion or a failure of the treaty. As first outlined by Jhering in 18611, the precontractual phase can establish a legal relationship in which precontractual obligations have to be respected. In the following, the precontractual liability under the German, French and Portuguese law will be compared. After an analysis of the historical origin of the precontractual liability in general and the presentation of the historical developments in Germany, France and Portugal, the legal problem, that needs a regulation in the legal orders, will be defined. Furthermore, in the com-parison of the regulatory framework, the similarities and differences of the current legislations in the three states will be examined based on various criteria such as the legal basis, the concrete precontractual duties and the relevance of the good faith. Apart from comparing compensable damages, the legal institutes in those states will be classified. Before summing up the compar-ison of the roots and the legal institute by also including a grid of the main comparative aspects, important cases will be presented to understand the development of the precontractual liability in Germany, France and Portugal.

Book excerpt: This book investigates the diverse ways in which the Portuguese language expanded in Brazil, despite the multilingual landscape that predominated before and after the arrival of the Europeans and the African diaspora. Challenging the assumption that the prevalence of Portuguese was a natural consequence and foregone conclusion of colonisation, the book argues that the language’s expansion was as much a result of state intervention as of individual agency. The growth of the Portuguese language was a tumultuous process that mirrored the power relations and conflicts between Amerindian, European, African, and mestizo actors who shaped, standardised, and promoted the language within and beyond state institutions. Knowing Portuguese became an identification sign of being Brazilian. However, a significant number of languages disappeared along the way, and the book highlights that virtual language homogeneity does not imply social equality. Portuguese’s variants place speakers on different social levels that justify domination and inequality. This research tells the history of a victorious language and other languages that left their mark on Brazilian Portuguese. A Plurilingual History of the Portuguese Language in the Luso-Brazilian Empire is a useful resource for scholars interested in the history and standardisation of languages, Portuguese and Brazilian history, and the impacts of colonisation.
