Book excerpt: Coming into the field as a Translator of Calvin so late as I do, and after the various able Preliminary Notices of my predecessors in the task, it would ill become me to offer any lengthened remarks, either generally on the personal character and theological system of our illustrious author,or more particularly on his merits as a Commentator upon Scripture. It may not, however, be deemed superfluous that I should refer my readers to the brief but interesting Memoir of Calvin, written by his associate and friend Theodore Beza, and translated by Henry Beveridge, Esq., in Volume I. of Calvin’s Tracts in this Series. It would, I presume, be scarcely possible to produce within a similar compass any Biography of the great Reformer which could at all be brought in to competition with this.

Book The Harmony of the Law Volume 1

Download or read book The Harmony of the Law Volume 1 written by Jean Calvin and published by CreateSpace. This book was released on 2015-06-07 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: Jean (eng. John) Calvin developed his theology in his biblical commentaries as well as his sermons and treatises, but the most concise expression of his views is found in his magnum opus, the Institutes of the Christian Religion. He intended that the book be used as a summary of his views on Christian theology and that it be read in conjunction with his commentaries. Calvin provided many of the foundational documents for reformed churches, including documents on the catechism, the liturgy, and church governance. He also produced several confessions of faith in order to unite the churches. Calvin produced commentaries on most of the books of the Bible. His first commentary on Romans was published in 1540, and he planned to write commentaries on the entire New Testament. Six years passed before he wrote his second, a commentary on I Corinthians, but after that he devoted more attention to reaching his goal. Within four years he had published commentaries on all the Pauline epistles, and he also revised the commentary on Romans. He then turned his attention to the general epistles, dedicating them to Edward VI of England. By 1555 he had completed his work on the New Testament, finishing with the Acts and the Gospels (he omitted only the brief second and third Epistles of John and the Book of Revelation). For the Old Testament, he wrote commentaries on Isaiah, the books of the Pentateuch, the Psalms, and Joshua. The material for the commentaries often originated from lectures to students and ministers that he reworked for publication.

Book excerpt: “This is a big book, with big themes and an author with the necessary experience to back them up... It analyses the practical needs and market forces behind the emergence of a new transnational commercial and financial legal order, its international finance-driven impulses, concepts, and operation; the theoretical basis of the transnationalisation of the law in the professional sphere in that order; the autonomous sources of the new law merchant or modern lex mercatoria derived from the method of public international law, as well as its relationship to domestic and transnational public policy and public order requirements. The complete set in this magisterial work is made up of 6 volumes. Used independently, each volume allows the reader to delve into a particular topic. Alternatively, all volumes can be read together for a comprehensive overview of transnational comparative commercial, financial and trade law.

Volume 1, in the first chapter, covers the roots and foundations of private law; the different origins, structure, and orientation of civil and common law; the forces behind the emergence of a new transnational commercial and financial legal order, its meaning, concepts, and operation; the theoretical basis of the transnationalisation of the law in the professional sphere in that order; its methodology and the autonomous sources of the new law merchant or modern lex mercatoria, its international finance-driven impulses, and its relationship to domestic and transnational public policy and public order requirements. The second chapter covers the transnationalisation of dispute resolution in that order, especially international arbitration, and contains a critical analysis of the main challenges to its success, continuing credibility, and effectiveness. All three volumes may be purchased separately or as part of a single set.

Book Vienna Lectures on Legal Philosophy Volume 1

Download or read book Vienna Lectures on Legal Philosophy Volume 1 written by Christoph Bezemek and published by Bloomsbury Publishing. This book was released on 2018-06-14 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first volume of the Vienna Lectures on Legal Philosophy illustrates the remarkable scope of contemporary legal philosophy. It introduces methodological questions rooted in national academic discourses, discusses the origin of legal systems, and contrasts constitutionalist and monist approaches to the rule of law with the institutionalist approach most prominently and vigorously defended by Carl Schmitt. The issue at the core of these topics is which of these perspectives is more plausible in an age defined both by a 'postnational constellation' and the re-emergence of nationalist tendencies; an age in which the law increasingly cancels out borders only to see new frontiers erected.

Book excerpt: The Zapotec observe that 'a bad compromise is better than a good fight'. Why? This study of the legal system of the Zapotec village of Talea suggests that compromise and, more generally, harmony are strategies used by colonized groups to protect themselves from encroaching powerholders or strategies the colonizers use to defend themselves against organized subordinates. Harmony models are present, despite great organizational and cultural differences, in many parts of the world. However, the basic components of harmony ideology are the same everywhere: an emphasis on conciliation, recognition that resolution of conflict is inherently good and that its reverse - continued conflict or controversy - is bad, a view of harmonious behaviour as more civilized than disputing behaviour, the belief that consensus is of greater survival value than controversy. The book's central thesis is that harmony ideology in Talea today is both a product of nearly 500 years of colonial encounter and a strategy for resisting the state's political and cultural hegemony.
