Download or read book Law of the Sea in East Asia written by Keyuan Zou and published by Routledge. This book was released on 2013-04-03 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law of the Sea in East Asia selects the most prominent maritime legal issues that have emerged since the post-LOS Convention era for a detailed discussion and assessment. The current marine legal order in East Asia is based on the 1982 United Nations Convention on the Law of the Sea (LOS Convention) and accordingly coastal states in the region are obliged to cooperate amongst themselves to exercise their rights and perform their duties. Keyuan, a respected expert in the fields of international and Chinese law, explores issues concerning compliance with the law of the sea, territorial disputes and maritime boundary delimitation, fishery management, safety of navigation and maritime security, and neglected issues in the law of the sea. This is the first book to examine maritime laws in East Asia, and as such will appeal to academics of law and Asian studies, lawyers and policy makers.
Download or read book Specially Protected Marine Areas in the Exclusive Economic Zone EEZ written by Thomas Dux and published by LIT Verlag Münster. This book was released on 2011 with total page 551 pages. Available in PDF, EPUB and Kindle. Book excerpt: This thesis examines the question of what States are legally empowered to do under international law when they seek to protect certain areas of their Exclusive Economic Zone (EEZ). In this context, the regulation of shipping and other human activities under the Law of the Sea Convention and, in particular, the regime for special areas under Article 211(6) of the Convention are addressed. Global and regional instruments containing mechanisms to protect specific areas are discussed and relevant State practice is considered with a view to possible implications on customary international law. Finally, guidance is given as to what States can practically do to protect specific areas of their EEZ for environmental reason. (Series: Schriften zum See- und Hafenrecht - Vol. 18)
Download or read book The Iran United States Claims Tribunal written by Charles N. Brower and published by BRILL. This book was released on 2023-12-28 with total page 953 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Iran-United States Claims Tribunal is arguably the most significant arbitral institution of the twentieth century. Although the completion of its last few cases could take a long time, the Tribunal's impressive work must be made available now as a guide to the resolution of ongoing disputes and for future tribunals. The Tribunal has, by this point, disposed of well over 98 percent of its caseload. Little more remains for its participants to learn, but the Tribunal shows no signs of fading away. Both of the two States Parties, for different reasons, see greater advantage in the Tribunal's prolongation than in its elimination. The authors have succeeded in dealing with all of the most deserving Tribunal subjects. Moreover, their intimate involvement in and knowledge of the Tribunal ensure that their book is a fascinating, important, and indispensable contribution to the literature of International Law. This is a definitive book on a monumental event in the law and in history at the close of a century. The Iran-United States Claims Tribunal was awarded the ASIL Certificate of Merit.

Download or read book Orderly and Humane written by R. M. Douglas and published by Yale University Press. This book was released on 2012-06-26 with total page 696 pages. Available in PDF, EPUB and Kindle. Book excerpt: The award-winning history of 12 million German-speaking civilians in Europe who were driven from their homes after WWII: “a major achievement” (New Republic). Immediately after the Second World War, the victorious Allies authorized the forced relocation of ethnic Germans from their homes across central and southern Europe to Germany. The numbers were almost unimaginable: between 12 and 14 million civilians, most of them women and children. And the losses were horrifying: at least five hundred thousand people, and perhaps many more, died while detained in former concentration camps, locked in trains, or after arriving in Germany malnourished, and homeless. In this authoritative and objective account, historian R.M. Douglas examines an aspect of European history that few have wished to confront, exploring how the forced migrations were conceived, planned, and executed, and how their legacy reverberates throughout central Europe today. The first comprehensive history of this immense manmade catastrophe, Orderly and Humane is an important study of the largest recorded episode of what we now call "ethnic cleansing." It may also be the most significant untold story of the World War II.
Download or read book International Watercourses Law for the 21st Century written by Surya P.Subedi and published by Routledge. This book was released on 2016-12-05 with total page 383 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited volume presents a comprehensive and comparative view of the law of international watercourses with special reference to the issues facing the Ganges River basin. It provides an analysis of the development of international waterways law and outlines the essentials of the UN Convention on non-navigational uses of international watercourses. Focusing on relations between the three riparian states of the River Ganges and the potential for cooperation, the volume also examines the domestic legal regimes of the area and the political dimension to the issues of sharing the waters of the river. The work presents a comparative picture with an analysis of developments in the Rhine and Mekong basins, comparing developments in the legal regimes of these areas with the experience of South Asia. Presenting an up-to-date analysis of the current law and pointing the direction for future developments, this collection will be a valuable resource for academics, researchers and policy makers working in this area.

The Use of Nuclear Weapons and the Protection of the Environment during International Armed Conflict
Download or read book The Use of Nuclear Weapons and the Protection of the Environment during International Armed Conflict written by Erik V Koppe and published by Bloomsbury Publishing. This book was released on 2008-04-25 with total page 458 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1996, the International Court of Justice delivered an Advisory Opinion on the legality of the use of nuclear weapons in which the Court stated that "while the existing international law relating to the protection and safeguarding of the environment does not specifically prohibit the use of nuclear weapons it indicates important environmental factors that are properly to be taken into account in the context of the implementation of the principles and rules of the law applicable in armed conflict." The present work analyses this conclusion, focusing on the question whether or not the use of nuclear weapons during international armed conflict would violate existing norms of public international law relating to the protection and safeguarding of the environment. Although the use of weaponry during armed conflict is usually related to the protection of individuals, the rapidly emerging appreciation of, and the worldwide realization of the intrinsic value of, the natural environment as an indispensable asset for the continuation of life, including human life, on this planet, both for present and future generations, warrants a thorough and extensive examination of the question of the (il)legality of the employment of nuclear weapons from the point of view of international environmental protection law. The book consists of two parts. Part I discusses the historical development and the effects of nuclear weapons; Part II discusses the protection of the environment during international armed conflict under ius in bello, ius ad bellum and ius pacis. Only then is it possible to assess the legality of the use of nuclear weapons under this particular set of rules.
