Today Gypsies can be found in countries throughout the world, their distinct culture still intact in spite of the intense persecution they have endured. This authoritative collection brings together leading Gypsy and non-Gypsy scholars to examine the Romani legal system, an autonomous body of law based on an oral tradition and existing alongside dominant national legal networks. For centuries the Roma have survived by using defensive strategies, especially the absolute exclusion of gadje (non-Gypsies) from their private lives, their values, and information about Romani language and social institutions. Sexuality, gender, and the body are fundamental to Gypsy law, with rules that govern being pure (vujo) or impure (marime). Women play an important role in maintaining legal customs, having the power to sanction and to contaminate, but they are not directly involved in legal proceedings. These essays offer a comparative perspective on Romani legal procedures and identity, including topics such as the United States' criminalization of many aspects of Gypsy law, parallels between Jewish and Gypsy law, and legal distinctions between Romani communities. Belton focuses on the social generation of travellers as a cultural, ethnic and racial categorization, offering a rational explanation of the development of an itinerant population that is less ambiguous and more informative in terms of the social nature of the gypsy and traveller position than interpretations based on 'blood', 'breed', 'stock', ethnicity or race that dominate the literature.

Book excerpt: Since the Conservative government's reform of the law and policy relating to accommodation for Travelling People (Gypsies and Travellers) in 1992, there have been no changes to the legislation, despite a major review of housing law and policy commenced by the current Labour government in 2000. A primary motive given for the 1992 legal reforms was financial: that the cost to the public purse of providing sites for Travelling People was unjustifiably high. Yet no study was ever done into the costs of not providing sites. In addition to exploration of the financial costs experienced by local authorities in the UK, both as landowners and as providers of public services, the book also examines the financial, human and social costs suffered by private landowners, police services and Travelling People themselves. The book places these costs in context both by exploring the process of change to law and policy in this field in 1992, and the issues now raised by the 'Best Value' regime and other new obligations placed on public bodies by human rights and race relations laws. While much has been made of these groups’ glamorous origins and influence—such as the Freemasons’ genesis in King Solomon’s temple or the belief in the Illuminati’s control of modern geo-politics—few have explicitly examined the role of race and ethnicity in organizing and perpetuating these cloistered orders. This volume directly addresses the inattention paid to the salience of race in secret societies. Through an examination of the Historically Black and White Fraternities and Sororities, the Ku Klux Klan in the US, the Ekpe and Abakuj secret societies of Africa and the West Indies, Gypsies in the United Kingdom, Black and White Temperance Lodges, and African American Order of the Elks, this book traces the use of racial and ethnic identity in these organizations. This important contribution examines how such orders are both cause and consequence of colonization, segregation, and subjugation, as well as their varied roles as both catalysts and impediments to developing personal excellence, creating fictive kinship ties, and fostering racial uplift, nationalism, and cohesion.
