Book Family Law and Gender in the Middle East and North Africa

Download or read book Family Law and Gender in the Middle East and North Africa written by Adrien K. Wing and published by Cambridge University Press. This book was released on 2023-05-31 with total page 445 pages. Available in PDF, EPUB and Kindle. Book excerpt: The volume serves as reference point for anyone interested in the Middle East and North Africa as well as for those interested in women's rights and family law, generally or in the MENA region. It is the only book covering personal status codes of nearly a dozen countries. It covers Muslim family law in the following Middle East/north African countries: Tunisia, Egypt, Morocco, Algeria, Iraq, Lebanon, Jordan, Israel, Palestine, and Qatar. Some of these countries were heavily affected by the Arab Spring, and some were not. With authors from around the world, each chapter of the book provides a history of personal status law both before and after the revolutionary period. Tunisia emerges as the country that made the most significant progress politically and with respect to women's rights. A decade on from the Arab Spring, across the region there is more evidence of stasis than change.

Book La qu te anthropologique du droit

Download or read book La qu te anthropologique du droit written by Christoph Eberhard and published by KARTHALA Editions. This book was released on 2006 with total page 618 pages. Available in PDF, EPUB and Kindle.

Book Political and Constitutional Transitions in North Africa

Download or read book Political and Constitutional Transitions in North Africa written by Justin Frosini and published by Routledge. This book was released on 2014-12-05 with total page 197 pages. Available in PDF, EPUB and Kindle. Book excerpt: The transformations which are taking place in the Arab world are dynamic processes characterised by a number of variables that one can refer to as actors and factors. The implications of the Arab uprisings are important for the world at large; the Arab world’s successes, and failures, at this crucial moment may well serve as a model for other nations. Political and Constitutional Transitions in North Africa focuses on five Northern African countries- Tunisia, Egypt, Morocco, Libya and Algeria- examining specific institutions and actors participating in the political upheavals in North Africa since 2011, and placing them in a comparative perspective in order to better understand the processes at work. This book addresses issues pertinent to North African and Middle Eastern Studies, comparative constitutional law, political science and transitional studies and it contains contributions by experts in all these fields. Providing a significant contribution to the understanding of events that followed the immolation of Mohamed Bouazizi in Tunisia, this book is a valuable contribution to North African Studies, Middle Eastern Studies, Comparative Constitutional Law and Transitional Studies.

Book Comparative Succession Law

Download or read book Comparative Succession Law written by Kenneth G. C. Reid and published by . This book was released on 2011 with total page 523 pages. Available in PDF, EPUB and Kindle. Book excerpt: Launching a major new research project examining the principles of succession law in comparative perspective, this book discusses the formalities which the law imposes in order for a person to make a testamentary disposal of property. Among the questions considered are the following. How are wills made? What precisely are the rules - as to the signature of the testator, the use of witnesses, the need for a notary public or lawyer, and so on? Is there is a choice of will-type and, if so, which type is used most often and what are the advantages and disadvantages of each? How common is will-making or do most people die intestate? What happens if formalities are not observed? How can requirements of form be explained and justified? How did the law develop historically, what is the state of the law today, and what are the prospects for the future? The focus is on Europe, and on countries which have been influenced by the European experience. Thus in addition to giving a detailed treatment of the law in Austria, Belgium, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Poland, and Spain, the book explores legal developments in Australia, New Zealand, the United States of America, and in some of the countries of Latin America with a particular emphasis on Brazil. It also includes chapters on two of the mixed jurisdictions - Scotland and South Africa - and on Islamic Law. The book opens with chapters on Roman law and on the early modern law in Europe, thus setting the historical scene as well as anticipating and complementing the accounts of national history which appear in subsequent chapters; and it concludes with an assessment of the overall development of the law in the countries surveyed, and with some wider reflections on the nature and purpose of testamentary formalities.

Book excerpt: Winner, 2009 J. Russell Major Prize, American Historical AssociationWinner, 2009 Frances Richardson Keller-Sierra Prize, Western Association of Women HistoriansWinner, 2008 Charles E. Smith Award, European History section of the Southern Historical Association This groundbreaking study examines complex notions of paternity and fatherhood in modern France through the lens of contested paternity. Drawing from archival judicial records on paternity suits, paternity denials, deprivation of paternity, and adoption, from the end of the eighteenth century through the twentieth, Rachel G. Fuchs reveals how paternity was defined and how it functioned in the culture and experiences of individual men and women. She addresses the competing definitions of paternity and of families, how public policy toward paternity and the family shifted, and what individuals did to facilitate their personal and familial ideals and goals. Issues of paternity and the family have broad implications for an understanding of how private acts were governed by laws of the state. Focusing on paternity as a category of family history, Contested Paternity emphasizes the importance of fatherhood, the family, and the law within the greater context of changing attitudes toward parental responsibility.

Book Law and Religion in Multicultural Societies

Download or read book Law and Religion in Multicultural Societies written by Rubya Mehdi and published by Djoef Publishing. This book was released on 2008 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays concerns the co-existence of religious and secular laws in multicultural societies. By considering a wide range of societies, the book allows more comparisons and makes a much wider contribution than most others on the same topic. The majority of the papers in this book are either based on personal experience or on empirical social scientific research. The sociological approach means that both religious doctrine and legal doctrine are seen and discussed as social phenomena. Half of the studies in the book are focused on countries and societies in North America and Europe, including Britain, Canada, the European Union, Belgium, and Denmark. They consider other countries in their relationships to North America and Europe in consequence of immigration, and they contain many comparative reflections, thus opening up further possibilities of understanding society in the west. Law and Religion in Multicultural Societies is in many ways a global book on a global issu

Book Fathers Families and the State in France 1914 1945

Download or read book Fathers Families and the State in France 1914 1945 written by Kristen Stromberg Childers and published by Cornell University Press. This book was released on 2018-07-05 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: The state's policy with regard to fathers and fatherhood had a great impact on concepts of citizenship and gender in France in the era of the two World Wars. Drawing on new material that has only recently become available from the archives of the Vichy regime, Kristen Stromberg Childers analyzes the ways fathers were promoted as saviors of the nation after France's humiliating defeat by the Germans in June 1940. Childers argues that concern for the family and for the status of fathers in modern France was not merely a response to falling birthrates and German aggression, but was fundamental to the very notion of citizenship and political participation. The debate on men as gendered beings, Childers demonstrates, is central to the political, social, and cultural history of France in the modern age. The father figure became a focus as participants from all classes and across the political spectrum debated what was wrong with the French family and what policies were needed to remedy the problem. Childers examines how these policies were implemented, what they reveal about the development of the welfare state in France, and how they help explain the importance of Vichy in twentieth-century French history. Twenty-eight illustrations, including fifteen photographs, many never previously published, complement her argument.
