Book excerpt: Il volume analizza la legge 27 settembre 2021 n. 134, la cosiddetta "Riforma della giustizia penale", recante "Delega al Governo per l'efficienza del processo penale nonché in materia di giustizia riparativa e disposizioni per la celere definizione dei procedimenti giudiziari", pubblicata sulla Gazzetta Ufficiale del 4 ottobre. Nella parte iniziale del volume viene riportato il testo integrale della legge 134 del 24 settembre 2021 e, a seguire, gli articoli del Codice penale e del Codice di procedura penale così come sono stati modificati dall'intervento normativo. A seguire gli approfondimenti curati dagli Autori di riferimento di Guida al Diritto, divisi in tre nuclei essenziali. Il primo nucleo riguarda le questioni problematiche, cioè il fattore organizzativo, l'istituto dell'improcedibilità e i criteri di priorità per l'esercizio dell'azione penale. Il secondo nucleo attiene, invece, alle disposizioni immediatamente in vigore dal 19 ottobre contenute nell'articolo 2 della delega. Il terzo e ultimo nucleo, infine, riguarda la delega penale in senso stretto, cioè l'articolo 1 della legge 134/2021; le materie interessate dalla delega penale sono molteplici e riguardano sia la fase precedente al giudizio penale che quella successiva, nonché alcuni aspetti del processo in senso stretto. Questo volume raccoglie i contributi apparsi sui numeri 40 e 41 del 2021 di Guida al Diritto.
