Recent times have seen the contours of water policy shaped by new discourses and narratives; there has been a pluralization of the state and a changing balance of power among the actors who influence the formulation of water policy. Discourses on gender mainstreaming and Integrated Water Resource Management (IWRM) are influential, though they have often remained rhetorical and difficult to put into practice. Debate over property rights reform and inter-linking of rivers has been polarized. At the same time, there has been a rising disenchantment with policy initiatives in participatory irrigation management, cleaning up of water bodies and pollution control. Fast depletion of groundwater resources and the importance of adopting new irrigation methods are getting increased focus in the recent policy dialogue. The contributors review current debate on these and other subjects shaping the governance of water resources, and take stock of new policy developments. The book examines the experience of policy implementation, and shows where important weaknesses still lie. The authors present a roadmap for the future, and discuss the potential of alternative approaches for tackling emerging challenges. A case is made for greater emphasis on a discursive analysis of water policy, to examine underlying policy processes. The contributors observe that the ongoing democratization of water governance, coupled with the multiplication of stresses on water, will create a more visible demand for platforms for negotiation, conflict resolution and dialogue across different categories of users and uses. Book excerpt: Historically, India has relied heavily on groundwater for agriculture with approximately, 80% of irrigated water being sourced from groundwater. This paper aims to analyze the relation between the production of water intensive crops and groundwater depletion in India. I study the crop production of 3 crops: sugarcane, cotton and rice and hypothesize that there exists a positive relationship between the production of water intensive crops and groundwater depletion. Using a novel dataset, I estimate time fixed effects and Generalized Methods of Moments (GMM) models to study this relationship. The fixed effects model shows that an increase of 1% in total area under production of rice, sugarcane and cotton is associated with an increase of 0.009 % in the distance between the ground level and the groundwater table, which is approximately equivalent to a loss of 7,191 liters of groundwater per Hectare. Using GMM, I find that a fall of 22,372 liters of groundwater associated with a 1 Ha increase in total area under production of highly water intensive crops. The results have critical policy implications for groundwater management and agricultural practices in India. These include solutions like watershed management and better rainwater harvesting to reduce the overdraft from the country’s “water banks”. In particular, based on my findings, I propose a review of energy subsidies in the agricultural sector especially as they may create perverse incentives to grow water intensive crops in areas where groundwater is low. The results also highlight the need for inclusion of groundwater as a critical input in the Soil Health Cards scheme, which is currently being rolled out by the Government of India. Sustainable crop choices can be made by considering groundwater levels, especially in the case of water intensive crops, as their production is related to the overdraft in India’s water banks.

It accomplishes this objective by examining how some of the States and Union Territories regulate and manage groundwater through the legal instrumentality against the backdrop of the two conflicting paradigms: the “elitist” and the “egalitarian.” The book’s fundamental premise is that despite being an extraordinarily critical resource that supports India’s burgeoning population’s ever-increasing water demands, groundwater is abused and mismanaged. The key argument that it posits is that the elitist paradigm must give way to an egalitarian one where groundwater is treated as a common property resource. To place this message in perspective, the book’s introduction explains the dichotomy between the two paradigms in the context of groundwater. This sets the stage, after which the book is divided thematically into three parts. The first part deals with some of the general groundwater management concerns brought to the fore by the operation of the elitist paradigm. Since water is constitutionally a State subject, the second part analyses the groundwater legislations of different States and Union Territories set against their unique circumstances. As these laws do not dismantle the elitist paradigm that interlocks groundwater rights to land rights, the next part articulates the legal reform agenda where a case is made to re-engineer groundwater laws to reflect a more sustainable basis.
