It aims at reducing total emissions of GHG by at least 5% of the level of emissions in 1990, during the period 2008-12. The EU Emissions Trading Scheme (EU ETS) is based on the recognition that creating a price for carbon emissions is the most cost-effective way to achieve the deep reductions in global GHG emissions that are needed to prevent climate change from reaching dangerous levels. The first section of the present essay outlines the problem of climate change and how the international legal framework addresses it. In the second section, the cap-and-trade system is discussed as a flexible mechanism for climate protection. The next section identifies three theoretic models of the ETS: Economic Efficiency, Private Property Rights and Command-and-Control models. The fifth section outlines the EU ETS and discusses its main components. Finally, in the last section a critical analysis of the EU ETS is presented in terms of three main criticisms: target achievement, perverse incentives and economization of an ecological problem.

Book excerpt: Why the traditional “pledge and review” climate agreements have failed, and how carbon pricing, based on trust and reciprocity, could succeed. After twenty-five years of failure, climate negotiations continue to use a “pledge and review” approach: countries pledge (almost anything), subject to (unenforced) review. This approach ignores everything we know about human cooperation. In this book, leading economists describe an alternate model for climate agreements, drawing on the work of the late Nobel laureate Elinor Ostrom and others. They show that a “common commitment” scheme is more effective than an “individual commitment” scheme; the latter depends on altruism while the former involves reciprocity (“we will if you will”). The contributors propose that global carbon pricing is the best candidate for a reciprocal common commitment in climate negotiations. Each country would commit to placing charges on carbon emissions sufficient to match an agreed global price formula. The contributors show that carbon pricing would facilitate negotiations and enforcement, improve efficiency and flexibility, and make other climate policies more effective. California's Global Warming Solutions Act of 2006, also referred to as A.B. 32, and the associated greenhouse gas emission trading program are one set of such efforts. With A.B. 32, the state of California has created one of the most comprehensive and complex climate change programs in the world - a legally binding set of mandates for the state government to reduce greenhouse gas (GHG) emissions to 1990 levels by the year 2020 that is implemented in part by a highly sophisticated GHG trading system. Although a number of years have already passed since A.B. 32's first enactment, the highest-profile regulatory action, the emission trading program, also referred to as a cap-and-trade system, became effective only recently. This short essay is designed to provide an introduction to the basic aspects of the California Global Warming Solutions Act as well as the GHG Emission Trading Program. In particular, the essay will touch on the scope of the emission trading program's carbon cap and what sources are covered, the cap decline by 2020, carbon allowances and offset-credits as well as related allowance banking issues, reporting and compliance processes, and linkage with other emission trading systems.

Book excerpt: How the Regional Greenhouse Gas Initiative created a new paradigm in climate policy by requiring polluters to pay for their emissions for the first time. In 2008, a group of states in the northeast United States launched an emissions trading program, the Regional Greenhouse Gas Initiative (RGGI). With RGGI, these states—Connecticut, Delaware, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Rhode Island, and Vermont—achieved what had been considered politically impossible: they forced polluters to pay the public for their emissions. The states accomplished this by conducting auctions of emissions “allowances”; by 2014, they had raised more than $2.2 billion in revenues. In this first in-depth examination of RGGI, Leigh Raymond describes this revolutionary and influential policy model and explains the practical and theoretical implications for climate policy. Other cap-and-trade schemes had been criticized for providing private profits rather than public benefits, allowing private firms to make money by buying and selling valuable “rights to pollute.” RGGI, by contrast, directed virtually all emissions auction revenues to programs benefiting the public at large. By reframing the issue in terms of public benefits, environmental advocates emphasized the public ownership of the atmospheric commons and private corporations' responsibility to pay for their use of it. Raymond argues that this kind of “normative reframing” is significant not only for environmental policy making but also for theories of the policy process, helping to explain and predict sudden policy change.
