Book Global Commons and the Law of the Sea

Download or read book Global Commons and the Law of the Sea written by Keyuan Zou and published by BRILL. This book was released on 2018-08-13 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Global Commons’ refers to resource domains or areas that lie outside of the political reach of any one State, including sea areas beyond national jurisdiction and Antarctica. The concept of ‘global commons’ is a living concept and can accommodate, over time, other commons at the international level, such as biodiversity and generic resources. The outlook for the global marine commons is not encouraging: fishery resources continue to deplete, marine biodiversity continues to reduce, and plastic wastes in the oceans continue to increase. In international law, there are legal regimes governing global marine commons, the most important of which is the 1982 United Nations Convention on the Law of the Sea (LOSC). Effective as of 1994 LOSC governs the high seas, international seabed and its resources, marine environmental protection, and fisheries. Global Commons and the Law of the Sea offers intellectual discussions on global marine commons. It contains six parts respectively addressing the principle of the common heritage of mankind (CHM), freedoms of high seas, deep sea mining and international seabed, area beyond national jurisdiction (ABNJ) governance, management of geoengineering and generic resources, and recent developments in the polar regions.

Download or read book The Global Commons written by Susan J. Buck and published by Island Press. This book was released on 2012-06-22 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: Vast areas of valuable resources unfettered by legal rights have, for centuries, been the central target of human exploitation and appropriation. The global commons -- Antarctica, the high seas and deep seabed minerals, the atmosphere, and space -- have remained exceptions only because access has been difficult or impossible, and the technology for successful extraction has been lacking. Now, technology has caught up with desire, and management regimes are needed to guide human use of these important resource domains. In The Global Commons, Susan Buck considers the history of human interactions with each of the global commons areas and provides a concise yet thorough account of the evolution of management regimes for each area. She explains historical underpinnings of international law, examines the stakeholders involved, and discusses current policy and problems associated with it. Buck applies key analytical concepts drawn from institutional analysis and regime theory to examine how legal and political concerns have affected the evolution of management regimes for the global commons. She presents in-depth case studies of each of the four regimes, outlining the historical evolution of the commons -- development of interest in exploiting the resource domain; conflicts among nations over the use of the commons; and efforts to design institutions to control access to the domains and to regulate their use -- and concluding with a description of the management regime that eventually emerged from the informal and formal negotiations. The Global Commons provides a clear, useful introduction to the subject that will be of interest to general readers as well as to students in international relations and international environmental law, and in environmental law and policy generally.

Book Security in the Global Commons and Beyond

Download or read book Security in the Global Commons and Beyond written by J. Martín Ramírez and published by Springer Nature. This book was released on 2021-04-10 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with two areas: Global Commons and Security: inextricably melted together and more relevant than ever in a world which is ever globalized and... with an incognita looming on the horizon: the effects of the Coronavirus pandemic upon the International Relations and globalization. Global Commons have always been relevant. It was Mahan who argued that the first and most obvious light in which the sea presents itself from the political and social point of view, is that of a great highway; or better, perhaps, of a wide common... Nowadays, this view has been further developed and, in addition to the unique legal implications that the Global Commons introduce, they are viewed, more and more intently, as a common pool of resources. Or perhaps, not that common... Resources, the key word! Which has to be always supplemented by two key words: access and security. And still, another one: data, the cyberspace contribution to the equation.

Book Reflections on the Making of the Modern Law of the Sea

Download or read book Reflections on the Making of the Modern Law of the Sea written by Satya N. Nandan and published by . This book was released on 2021 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The United Nations Convention on the Law of the Sea (UNCLOS) is one of the most successful agreements ever created to govern the global commons. If it is thought of as a constitution for the oceans, then Satya Nandan should be considered one of the founders, one of the key personalities behind both the agreement and the subsequent development of Law of the Sea in the decades since UNCLOS was adopted. He led the drafting of the key negotiating text, most of which made its way, unaltered, into the Convention’s final text. How did a lawyer from Fiji come to play such a pivotal role in this important area of diplomacy and international law? This book tells the story, showing how Nandan used his creativity, pragmatism, and penchant for language to reach compromise and build consensus at nearly every stage in the making of the modern law of the sea. In this book, he elaborates on the techniques and skills he brought to bear on this task, the alliances he formed with colleagues from different countries, and the strategies that were effective in this complex, multidimensional negotiation. At a time when the stakes involved in managing the global commons could not be higher, Satya Nandan’s experience and wisdom could not be more relevant and important."--Publisher description.

This book was released on 2021-04-02 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses he implementation of the United Nations Convention on the Law of the Sea (UNCLOS) in the light of state practices of China and Japan. The special character of the book can be found in its structure of comparative analysis of the practices of China and Japan in each part. The focus is on historical aspects (Part I), implementation of the UNCLOS (Part II), navigation (Part III), mid-ocean archipelagos (Part IV), the marine environment (Part V), and dispute settlement (Part VI). By taking this approach, the book elucidates a variety of aspects of history, difficulties, problems, and controversies arising from the implementation of the UNCLOS by the two nations. Furthermore, contributors from China and Japan tend to show different perspectives on the UNCLOS, which, by clarifying the need for further debate, are expected to contribute to the continuing cooperation between the academics of the two states.

Book The Concept of the Common Heritage of Mankind in International Law

Download or read book The Concept of the Common Heritage of Mankind in International Law written by Kemal Baslar and published by BRILL. This book was released on 2024-02-06 with total page 460 pages. Available in PDF, EPUB and Kindle. Book excerpt: The concept of the common heritage of mankind is one of the most extraordinary developments in recent intellectual history and one of the most revolutionary and radical legal concepts to have emerged in recent decades. The year 1997 marks the thirtieth anniversary of the advent of the concept in the domain of public international law. Ever since its emergence, it has become evident that no other concept, notion, principle or doctrine has brought as much intensive debate, controversy, confrontation and speculation as the common heritage phenomenon did. This is because it is a philosophical idea that questions the regimes of globally important resources regardless of their situation, and requires major changes in the world to apply its provisions. In other words, the application and enforcement of the common heritage of mankind require a critical reexamination of many well-established principles and doctrines of classical international law, such as acquisition of territory, consent-based sources of international law, sovereignty, equality, resource allocation and international personality. This book aims to explore the legal theory and implications of the concept of the common heritage of mankind. It addresses almost all aspects of the concept in the light of the experience of three decades. The author takes into account the elements of the common heritage concept in the fields of jurisprudence, outer space law, the law of the sea, the law of Antarctica, international environmental law, human rights and general principles of public international law. It tries to develop a normative framework through which the concept may offer alternatives for the governance of the global commons.

Book Law of the Sea

Download or read book Law of the Sea written by Harry N. Scheiber and published by BRILL. This book was released on 2021-07-26 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: The last quarter century has witnessed vast changes in the governance of ocean space and resources. The keystone instrument in the new legal order is the 1982 UN Law of the Sea Convention, an agreement comprehensive in its scope that has provided the framework for further innovations in marine policy and ocean law. Accelerated change in the 1990s included the revision and the going-into-force of the 1982 Convention; and the conclusion of new international agreements on biodiversity, on the management of fishery stocks in international waters, and on marine navigation and safety. There has also been renewed impetus for regionalization of marine management and conservation efforts. These and other leading issues facing the global community today are the subjects of essays in this volume. The authors, acknowledged authorities in the field, offer fresh and searching reappraisals of how the 'common heritage' concepts in ocean law have been challenged by the contemporary crises in marine uses and ocean environment and resources. How national governments and international organizations have responded to urgent questions of ocean management is a major focus of these studies, and the book also provides important historical perspective on the doctrinal legacy of earlier ocean law. Emerging legal norms and the principles of law, new procedural mandates, the problems of implementation, and recent institutional developments in the international arena all receive attention in this timely and provocative work.

Book Dispatches from the South China Sea

Download or read book Dispatches from the South China Sea written by James Borton and published by Universal-Publishers. This book was released on 2022-01-15 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: The impact of continuous coastal development, reclamation, destruction of corals, overfishing and increased maritime traffic places all of us on the front lines of preserving our oceans. Marine biologists, who share a common language that cuts across political, economic and social differences, recognize that the sea’s remarkable coral reefs, which provide food, jobs and protection against storms and floods, have suffered unprecedented rates of destruction in recent decades. Dispatches from the South China Sea’s blend of participatory research and field reportage paves the way for a transformation of policy and, provides a basis for the eventual resolution of some of today’s major maritime conflicts. From overfishing, illegal and unregulated fishing, coral reef destruction and reclamations, Dispatches from the South China Sea charts science-driven cooperation opportunities. James Borton purposefully and passionately argues that the South China Sea can become a body of water that unites, rather than divides.
