Book All the Laws but One

Download or read book All the Laws but One written by William H. Rehnquist and published by Vintage. This book was released on 2007-12-18 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: William H. Rehnquist, Chief Justice of the United States, provides an insightful and fascinating account of the history of civil liberties during wartime and illuminates the cases where presidents have suspended the law in the name of national security. "A highly original account of the proper role of the Supreme Court, a role that makes most sense in times of war, but that has its attractions whenever the Court is embroiled in great social controversies." --The New Republic Abraham Lincoln, champion of freedom and the rights of man, suspended the writ of habeas corpus early in the Civil War--later in the war he also imposed limits upon freedom of speech and the press and demanded that political criminals be tried in military courts. During World War II, the government forced 100,000 U.S. residents of Japanese descent, including many citizens, into detainment camps. Through these and other incidents Chief Justice Rehnquist brilliantly probes the issues at stake in the balance between the national interest and personal freedoms. With All the Laws but One he significantly enlarges our understanding of how the Supreme Court has interpreted the Constitution during past periods of national crisis--and draws guidelines for how it should do so in the future.

Book Constitutional Conscience

    Book Details:
  • Author : H. Jefferson Powell
  • Publisher : University of Chicago Press
  • Release : 2008-09-15
  • ISBN : 0226677303
  • Pages : 161 pages

Download or read book Constitutional Conscience written by H. Jefferson Powell and published by University of Chicago Press. This book was released on 2008-09-15 with total page 161 pages. Available in PDF, EPUB and Kindle. Book excerpt: While many recent observers have accused American judges—especially Supreme Court justices—of being too driven by politics and ideology, others have argued that judges are justified in using their positions to advance personal views. Advocating a different approach—one that eschews ideology but still values personal perspective—H. Jefferson Powell makes a compelling case for the centrality of individual conscience in constitutional decision making. Powell argues that almost every controversial decision has more than one constitutionally defensible resolution. In such cases, he goes on to contend, the language and ideals of the Constitution require judges to decide in good faith, exercising what Powell calls the constitutional virtues: candor, intellectual honesty, humility about the limits of constitutional adjudication, and willingness to admit that they do not have all the answers. Constitutional Conscience concludes that the need for these qualities in judges—as well as lawyers and citizens—is implicit in our constitutional practices, and that without them judicial review would forfeit both its own integrity and the credibility of the courts themselves.

Book Child Welfare and Child Well Being

Download or read book Child Welfare and Child Well Being written by Mary Bruce Webb and published by Oxford University Press. This book was released on 2009-12-31 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: The landmark National Survey of Child and Adolescent Well-Being (NSCAW) study represents the first effort to gather nationally representative data, based on first-hand reports, about the well-being of children and families who encounter the child welfare system. NSCAW's findings offer an unprecedented national source of data that describe the developmental status and functional characteristics of children who come to the attention of child protective services. Much more than a simple history of placements or length of stay in foster care, NSCAW data chart the trajectory of families across service pathways for a multi-dimensional view of their specific needs. The NSCAW survey is longitudinal, contains direct assessments and reports about each child from multiple sources, and is designed to address questions of relations among children's characteristics and experiences, their development, their pathways through the child welfare service system, their service needs, their service receipt, and, ultimately, their well-being over time. The chapters in this rich synthesis of NSCAW data represent thoughtful and increasingly sophisticated approaches to the problems highlighted in the study and in child welfare research in general. The authors capitalize on the longitudinal, multidimensional data to capture the experiences of children and families from the time they are investigated by CPS though multiple follow-up points, and to consider the interdependent nature of the traditional child welfare outcomes of safety, permanence, and well-being. The topics covered not only are critical to child welfare practice and policy, but also are of compelling interest to other child service sectors such as health, mental health, education, and juvenile justice. The authors of chapters in this volume are esteemed researchers within psychology, social work, economics, and public health. Together they represent the future of child welfare research, showcasing the potential of NSCAW as a valuable resource to the research community and providing glimpses of how the data can be used to inform practice and policy.
