Book The Modern Law of Champerty and Maintenance

Download or read book The Modern Law of Champerty and Maintenance written by Rachael Mulheron and published by Oxford University Press. This book was released on 2023-07-21 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: As torts and as crimes, champerty and maintenance were abolished by statute in England and Wales in 1967. They were considered to be obsolete and the product of a bygone age, when abuses of the court system as practised by rich and powerful noblemen required a robust legal response. A modern, sophisticated, and independent judiciary rendered it unnecessary either to punish or to compensate for champerty or maintenance any longer. However, post-1967, their impact was retained via a 'reservation provision', which ensures that any contract tainted by champerty or maintenance 'is to be treated as contrary to public policy or otherwise illegal.' Fast forward five decades to the present day, and whilst maintenance has arguably reached its use-by date in English law, the same cannot be said of its more aggressive cousin. Champerty, as a doctrine, retains considerable modern impact in this jurisdiction, stalking the modern funding and civil procedure landscape. It continues to have greatest impact in two areas: the funding of litigation, and the assignments of causes of action. The Modern Doctrines of Champerty and Maintenance looks comparatively at jurisdictions' attitudes towards champerty and maintenance, together with an analysis of law reform studies in the area, both in England and elsewhere.

  • ISBN : 1000901300
  • Pages : 246 pages

Download or read book State Ocean Jurisdiction written by Patrick Henri Ghislain Vrancken and published by Taylor & Francis. This book was released on 2023-06-27 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: Proposing a systematic analytical framework which assists in understanding and applying the international law regime governing State ocean jurisdiction with a view to improved ocean governance for sustainable development, this book distinguishes between, and focuses on, the form, the ground, the scope and the purpose of State ocean jurisdiction. Defining jurisdiction as the international-law authority of a State to be involved in a factual matter on the basis of a valid legal ground to perform authoritative acts impacting on that matter, it disaggregates the concept the complexity of which often leads to States failing to make full use of their existing ocean jurisdictions. In the process, it identifies when and to what extent there are gaps and overlaps of jurisdictions. Bringing clarity on an inevitably complex and often misunderstood framework that is aimed at striking a universally accepted balance of competing interests, the book lays the foundation for future research, contextualising the position of State ocean jurisdiction not only in terms of ocean governance, but in the whole of public international law. With an original systematic focus on State ocean jurisdiction, the book will be of interest to academics, students and practitioners working in the areas of international law of the sea, ocean governance, human rights and environmental law.

Book Dark Freedom

Download or read book Dark Freedom written by F. Shelton Gonkerwon and published by AuthorHouse. This book was released on 2015-03-31 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dark Freedom is an incarnation of the overcast instances that reversed the social, political, and economic phenomenon of Liberia for a lengthened period and undermined peaceful coexistence of the people. It is a manifestation of the authors pungent experiences during the dark period when evils stood above morals, when love bowed low to hatred, when lawlessness was the common denominator of the day, when life lost value, and when the day was hosted by darkness, etc. Comparatively autobiographical, the book represents some personal as well as historical accounts regarding what occurred before, during, and after the brutal civil upheaval in Liberia. Judging from its name (Dark Freedom), one can securely sketch the conclusion that Liberians are blessed with copious natural riches but lack social and economic freedom and are constrained against their own will to live with poverty and assorted social evils. It is intended to remind succeeding generations about the stage-by-stage happenings during the Civil War so that its reoccurrence can be avoided or prevented. Balanced, practical, and a material that presents the truth above falsehood, readers will certainly find the book useful and historically valuable. Ellicot Sede, who performed a breakfast editing on the book, described it as a worthy historical reminder obsessed with facts and truth that researchers and scholars will find worthy.

Book The Reuniting of Europe

Download or read book The Reuniting of Europe written by José I. Torreblanca and published by Routledge. This book was released on 2017-09-20 with total page 223 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2001: In 1989, central and Eastern European countries broke free form the Soviet Union and looked upon the European Community to support their 'return to Europe'. Some years later, leaders of the European Community, meeting in Copenhagen in June 1993, endorsed for the first time the membership aspirations of the recently democratized countries of Central and Eastern Europe. This insightful text examines the negotiations, debates, tensions and contradictions behind the process of approximation between the two halves of Europe, both within the EC itself as well as between the EC and the countries of Central and Eastern Europe. The extensive consultation of unpublished internal documents, and a theoretically relevant and well-written analysis, ensures that this book is an indispensable resource for students and researchers of EC/EU relations with Central and Eastern Europe.
