Book The Doctrine of Odious Debt in International Law

Download or read book The Doctrine of Odious Debt in International Law written by Jeff King and published by Cambridge University Press. This book was released on 2016-05-26 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: According to the doctrine of odious debt, loans which are knowingly provided to subjugate or defraud the population of a debtor state are not legally binding against that state under international law. Breaking with widespread scepticism, this groundbreaking book reaffirms the original doctrine through a meticulous and definitive examination of state practice and legal history. It restates the doctrine by introducing a new classification of odious debts and defines 'odiousness' by reference to the current, much more determinate and litigated framework of existing public international law. Acknowledging that much of sovereign debt is now governed by the private law of New York and England, Jeff King explores how 'odious debts' in international law should also be regarded as contrary to public policy in private law. This book is essential reading for practising lawyers, scholars, and development and human rights workers.

But peace is to be short-lived... Mankind began a new existence on Jupiter millions of years after the sun expanded to become a red giant and eradicated all life on Earth. But they were not alone on their new home. The Gnathe, creatures with an incredibly aptitude for genetic engineering, had already established their civilization there and some of them did not welcome their new neighbours. But in the shadows the rumour of Link-soo-shan's return grows and it is clear that she has her own plans for revenge on the humans and their allies...

Book The International Law of Sovereign Debt Dispute Settlement

Download or read book The International Law of Sovereign Debt Dispute Settlement written by Kei Nakajima and published by Cambridge University Press. This book was released on 2022-09-22 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first two decades of the twenty-first century witnessed a series of large-scale sovereign defaults and debt restructurings, in which sovereigns struggled to negotiate with recalcitrant bondholders, particularly hedge funds. Also, the outbreak of the COVID-19 pandemic in 2020 heralded a bleak financial outlook for many developing and emerging market countries, requiring sovereign debt restructuring in times of great macroeconomic uncertainty. Given the absence of a multilateral mechanism for sovereign debt restructuring equivalent to domestic corporate bankruptcy system, however, defaulted sovereigns often suffer from holdout litigation wrought by bondholders. This book proposes ways in which such legal actions could be regulated without the undue expense of bondholders' remedies by exploring the mechanism of balancing bondholder protection and respect for sovereign debt restructuring at various stages of litigation and arbitration proceedings.

Book Toxic Debt

  • Pages : 345 pages

Download or read book Toxic Debt written by Josiah Rector and published by UNC Press Books. This book was released on 2022-02-17 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: From the mid-nineteenth until the mid-twentieth century, environmentally unregulated industrial capitalism produced outsized environmental risks for poor and working-class Detroiters, made all the worse for African Americans by housing and job discrimination. Then as the auto industry abandoned Detroit, the banking and real estate industries turned those risks into disasters with predatory loans to African American homebuyers, and to an increasingly indebted city government. Following years of cuts in welfare assistance to poor families and a devastating subprime mortgage meltdown, the state of Michigan used municipal debt to justify suspending democracy in majority-Black cities. In Detroit and Flint, austerity policies imposed under emergency financial management deprived hundreds of thousands of people of clean water, with lethal consequences that most recently exacerbated the spread of COVID-19. Toxic Debt is not only a book about racism, capitalism, and the making of these environmental disasters. It is also a history of Detroit's environmental justice movement, which emerged from over a century of battles over public health in the city and involved radical auto workers, ecofeminists, and working-class women fighting for clean water. Linking the histories of urban political economy, the environment, and social movements, Toxic Debt lucidly narrates the story of debt, environmental disaster, and resistance in Detroit.

Book Sovereign Debt

    Book Details:
  • Author : Mauro Megliani
  • Publisher : Springer
  • Release : 2014-11-21
  • ISBN : 331908464X
  • Pages : 617 pages

Download or read book Sovereign Debt written by Mauro Megliani and published by Springer. This book was released on 2014-11-21 with total page 617 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a thorough legal analysis of sovereign indebtedness, examining four typologies of sovereign debt – bilateral debt, multilateral debt, syndicated debt and bonded debt – in relation to three crucial contexts: genesis, restructuring and litigation. Its treatise-style approach makes it possible to capture in a systematic manner a phenomenon characterized by high complexity and unclear boundaries. Though the analysis is mainly conducted on the basis of international law, the breadth of this topical subject has made it necessary to include other sources, such as private international law, domestic law and financial practice; moreover, references are made to international financial relations and international financial history so as to provide a more complete understanding. Although it follows the structure of a continental tractatus, the work strikes a balance between consideration of doctrinal and jurisprudential sources, making it a valuable reference work for scholars and practitioners alike.

  • Publisher : Farrar, Straus and Giroux
  • Release : 2014-10-14

Download or read book Bad Paper written by Jake Halpern and published by Farrar, Straus and Giroux. This book was released on 2014-10-14 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Federal Trade Commission receives more complaints about rogue debt collecting than about any activity besides identity theft. Dramatically and entertainingly, Bad Paper reveals why. It tells the story of Aaron Siegel, a former banking executive, and Brandon Wilson, a former armed robber, who become partners and go in quest of "paper"—the uncollected debts that are sold off by banks for pennies on the dollar. As Aaron and Brandon learn, the world of consumer debt collection is an unregulated shadowland where operators often make unwarranted threats and even collect debts that are not theirs. Introducing an unforgettable cast of strivers and rogues, Jake Halpern chronicles their lives as they manage high-pressure call centers, hunt for paper in Las Vegas casinos, and meet in parked cars to sell the social security numbers and account information of unsuspecting consumers. He also tracks a "package" of debt that is stolen by unscrupulous collectors, leading to a dramatic showdown with guns in a Buffalo corner store. Along the way, he reveals the human cost of a system that compounds the troubles of hardworking Americans and permits banks to ignore their former customers. The result is a vital exposé that is also a bravura feat of storytelling.

Book The Capitalist Unconscious

Download or read book The Capitalist Unconscious written by Samo Tomsic and published by Verso Books. This book was released on 2015-12-08 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: A major systematic study of the connection between Marx and Lacan’s work Finalist for the American Board and Academy of Psychoanalysis Book Prize Despite a resurgence of interest in Lacanian psychoanalysis, particularly in terms of the light it casts on capitalist ideology—as witnessed by the work of Slavoj Žižek—there remain remarkably few systematic accounts of the role of Marx in Lacan’s work. A major, comprehensive study of the connection between their work, The Capitalist Unconscious resituates Marx in the broader context of Lacan’s teaching and insists on the capacity of psychoanalysis to reaffirm dialectical and materialist thought. Lacan’s unorthodox reading of Marx refigured such crucial concepts as alienation, jouissance and the Freudian ‘labour theory of the unconscious’. Tracing these developments, Tomšič maintains that psychoanalysis, structuralism and the critique of political economy participate in the same movement of thought; his book shows how to follow this movement through to some of its most important conclusions.
