Book excerpt: This book is an invitation to academic administrators, at every level, to engage in reflection on the ethical dimensions of their working lives. Academics are very good at reflecting on the ethical issues in other professions but not so interested in reflecting on those in their own, including those faced by faculty and administrators. Yet it is a topic of great importance. Academic institutions are value-driven; hence virtually every decision made by an academic administrator has an ethical component with implications for students, faculty, the institution, and the broader community. Despite this, they receive little systematic preparation for this aspect of their professional lives when they take up administrative posts, especially when compared to, say, medical or legal training. Surprisingly little has been written about the ethical challenges that academic administrators are likely to face. Most of the literature relating to academic administration focuses on “leadership” and draws heavily on management and social science theory. The importance of focusing on ethical deliberation and decision-making often goes unrecognized.

Harvard, too, has been indelibly scarred by slavery, exclusion, segregation, and other forms of racist oppression. At the same time, the nation's oldest university has also, at various times, stimulated, supported, or allowed itself to be influenced by the various reform movements that have dramatically changed the nature of race relations across the nation. The story of blacks at Harvard is thus inspiring but painful, instructive but ambiguous—a paradoxical episode in the most vexing controversy of American life: the "race question." The first and only book on its subject, Blacks at Harvard is distinguished by the rich variety of its sources. Included in this documentary history are scholarly overviews, poems, short stories, speeches, well-known memoirs by the famous, previously unpublished memoirs by the lesser known, newspaper accounts, letters, official papers of the university, and transcripts of debates. Among Harvard's black alumni and alumnae are such illustrious figures as W.E.B. Du Bois, Monroe Trotter, and Alain Locke; Countee Cullen and Sterling Brown both received graduate degrees. The editors have collected here writings as diverse as those of Booker T. Washington, William Hastie, Malcolm X, and Muriel Snowden to convey the complex ways in which Harvard has affected the thinking of African Americans and the ways, in turn, in which African Americans have influenced the traditions of Harvard and Radcliffe. Notable among the contributors are significant figures in African American letters: Phyllis Wheatley, William Melvin Kelley, Marita Bonner, James Alan McPherson and Andrea Lee. Equally prominent in the book are some of the nation's leading historians: Carter Woodson, Rayford Logan, John Hope Franklin, and Nathan I. Huggins. Book excerpt: A history of Harvard Law School in the twentieth century, focusing on the school’s precipitous decline prior to 1945 and its dramatic postwar resurgence amid national crises and internal discord. By the late nineteenth century, Harvard Law School had transformed legal education and become the preeminent professional school in the nation. But in the early 1900s, HLS came to the brink of financial failure and lagged its peers in scholarly innovation. It also honed an aggressive intellectual culture famously described by Learned Hand: “In the universe of truth, they lived by the sword. They asked no quarter of absolutes, and they gave none.” After World War II, however, HLS roared back. In this magisterial study, Bruce Kimball and Daniel Coquillette chronicle the school’s near collapse and dramatic resurgence across the twentieth century. The school’s struggles resulted in part from a debilitating cycle of tuition dependence, which deepened through the 1940s, as well as the suicides of two deans and the dalliance of another with the Nazi regime. HLS stubbornly resisted the admission of women, Jews, and African Americans, and fell behind the trend toward legal realism. But in the postwar years, under Dean Erwin Griswold, the school’s resurgence began, and Harvard Law would produce such major political and legal figures as Chief Justice John Roberts, Justice Elena Kagan, and President Barack Obama. Even so, the school faced severe crises arising from the civil rights movement, the Vietnam War, Critical Legal Studies, and its failure to enroll and retain people of color and women, including Justice Ruth Bader Ginsburg. Based on hitherto unavailable sources—including oral histories, personal letters, diaries, and financial records—The Intellectual Sword paints a compelling portrait of the law school widely considered the most influential in the world.

Langdell (1826-1906) is one of the most influential figures in the history of American professional education. As dean of Harvard Law School from 1870 to 1895, he conceived, designed, and built the educational model that leading professional schools in virtually all fields subsequently emulated. In this first full-length biography of the educator and jurist, Bruce Kimball explores Langdell's controversial role in modern professional education and in jurisprudence. Langdell founded his model on the idea of academic meritocracy. According to this principle, scholastic achievement should determine one's merit in professional life. Despite fierce opposition from students, faculty, alumni, and legal professionals, he designed and instituted a formal system of innovative policies based on meritocracy. This system's components included the admission requirement of a bachelor's degree, the sequenced curriculum and its extension to three years, the hurdle of annual examinations for continuation and graduation, the independent career track for professional faculty, the transformation of the professional library into a scholarly resource, the inductive pedagogy of teaching from cases, the organization of alumni to support the school, and a new, highly successful financial strategy. Langdell's model was subsequently adopted by leading law schools, medical schools, business schools, and the schools of other professions. By the time of his retirement as dean at Harvard, Langdell's reforms had shaped the future model for professional education throughout the United States.

After emancipation was achieved, they broadened their struggle to pursue equal rights for women, state medicine, workers' rights, fair wages, immigrants' rights, care of the poor, and a right to decent housing and a healthy environment. Focusing on the work of a key group of activists from 1835 to the dawn of the twentieth century, From Abolition to Rights for All investigates how reformers, linked together and radicalized by their shared experiences in the abolitionist struggle, articulated a core natural rights ideology and molded it into a rationale for successive reform movements. The book follows the abolitionists' struggles and successes in organizing a social movement. For a time after the Civil War these reformers occupied major positions of power, only to be rebuffed in the later years of the nineteenth century as the larger society rejected their inclusive understanding of natural rights. The narrative of perseverance among this small group would be a continuing source of inspiration for reform. The pattern they established—local organization, expansive vision, and eventual challenge by powerful business interests and individuals—would be mirrored shortly thereafter by Progressives.
