Book excerpt: Over the past years we have witnessed patents related to in vitro diagnostic methods, as well as patents on human genes. Although patents on diagnostics and patents on human genes are not novel, patents on genes for diagnostics are a rather unseen combination. The grant by the European Patent Organisation (EPO) of patents covering the breast cancer gene (BRCA), its mutations, as well as diagnostic and therapeutic applications based on the gene's sequence, evoked strong reactions and led to the questioning of the nature, legitimacy and scope of gene patents and diagnostic methods instrumental to public health. Although various of the initially granted breast cancer patents have been revoked or restricted, the discussion lingers on, as no final decision is available on the exact scope of the patents as yet. So, recent events have put the delicate relationship between patents and medicine to the test again. The present paper provides an in-depth introduction to the book 'Gene Patents and Public Health', and examines and discusses the delicate balance between patents and medicine, and more in particular to the relationship between diagnostic gene patents and health care.

Book excerpt: The patenting and licensing of human genetic material and proteins represents an extension of intellectual property (IP) rights to naturally occurring biological material and scientific information, much of it well upstream of drugs and other disease therapies. This report concludes that IP restrictions rarely impose significant burdens on biomedical research, but there are reasons to be apprehensive about their future impact on scientific advances in this area. The report recommends 13 actions that policy-makers, courts, universities, and health and patent officials should take to prevent the increasingly complex web of IP protections from getting in the way of potential breakthroughs in genomic and proteomic research. It endorses the National Institutes of Health guidelines for technology licensing, data sharing, and research material exchanges and says that oversight of compliance should be strengthened. It recommends enactment of a statutory exception from infringement liability for research on a patented invention and raising the bar somewhat to qualify for a patent on upstream research discoveries in biotechnology. With respect to genetic diagnostic tests to detect patient mutations associated with certain diseases, the report urges patent holders to allow others to perform the tests for purposes of verifying the results.

Book excerpt: On 4 December 2002 the Australian Government announced that it would ask the Australian Law Reform Commission (ALRC) to conduct an Inquiry into intellectual property issues raised by genetic information. The Terms of Reference required the ALRC to examine the impact of patent laws and practices as they relate to 'genes and genetic and related technologies.' This was to be done in three contexts: the conduct of research and its subsequent application and commercialisation; the Australian biotechnology sector; and the cost-effective provision of healthcare. The ALRC was also asked to report on what changes may be required to address any problems that were identified in current laws and practices 'with the aim of encouraging the creation and use of intellectual property to further the health and economic benefits of genetic research and genetic and related technologies.' In making its Inquiry, the ALRC was also to have regard to a number of considerations including: the role of intellectual property rights in promoting technological innovation; the potential for human genetics to improve the quality of life of all Australians; the ethical, legal and social issues arising from intellectual property in genes and genetic technologies; the national interest in using genetic technologies in agriculture and industry; trade and investment issues affecting intellecutal property; and international obligations and practices, both existing and proposed.

Faced with an unprecedented health crisis ? 8,000 people dying daily ? the public health community launched an unprecedented global effort that eventually resulted in the large-scale availability of low-priced generic HIV medicines. 0But now, high prices of new medicines - for example, for cancer, tuberculosis and hepatitis C - are limiting access to treatment in low-, middle and high-income countries alike. Book excerpt: A comparative study of genetic testing for breast and ovarian cancer in the United States and Britain that shows the importance of national context in the development and use of science and technology even in an era of globalization. In Building Genetic Medicine, Shobita Parthasarathy shows how, even in an era of globalization, national context is playing an important role in the development and use of genetic technologies. Focusing on the development and deployment of genetic testing for breast and ovarian cancer (known as BRCA testing) in the United States and Britain, Parthasarathy develops a comparative analysis framework in order to investigate how national “toolkits” shape both regulations and the architectures of technologies and uses this framework to assess the implications of new genetic technologies. Parthasarathy argues that differences in the American and British approaches to health care and commercialization of research led to the establishment of different BRCA services in the two countries. In Britain, the technology was available through the National Health Service as an integrated program of counseling and laboratory analysis, and was viewed as a potentially cost-effective form of preventive care. In the United States, although BRCA testing was initially offered by a number of providers, one company eventually became the sole provider of a test available to consumers on demand. Parthasarathy draws lessons for the future of genetic medicine from these cross-national differences, and discusses the ways in which comparative case studies can inform policy-making efforts in science and technology.
