The aim of the organizers was to show what problems existed during the transition from dictatorship to democracy in several countries around the world. They all enacted laws or other measures to ensure that fundamental rights and the rule of law would resist anti-democratic ideologies, anti-Semitism, racism, and war crimes in the future. However, the legal system and law in these countries themselves often had their origins in dictatorship. Thus, there were and are obvious and hidden anti-democratic continuities that influence law and the legal system up to the present. Scientifics and jurists from Italy, Japan, Poland, Spain, South Africa, and Germany examine these continuities in their contributions.

Book excerpt: The study of civil-military relations in Latin America produced a rich debate and research agenda prior to 2000. But this agenda was largely abandoned during the past decade as the spectre of military dictatorship has virtually disappeared, with the political role of the military in many countries dramatically diminished. Indeed, in no country that has initiated a process of holding the military accountable to civilian control has the military openly rebelled. Yet, the institutions and public attitudes that guarantee democratic civilian control of the military exist in a general context of political polarisation, citizen insecurity and in many countries a sense of developing ungovernability. The military coup in Honduras (2009), the military response to the police rebellion in Ecuador (2010), and the speculation concerning the Venezuelan military's behaviour in the event that Hugo Chavez is incapacitated or dies (2013), demonstrates the relevance and importance of the civil-military relationship today. In this volume leading scholars from Latin America, the U.S. and Spain debate the ability of contemporary Latin American civil-military relationships to weather these challenges. The authors examine new types of regimes (the rise of participatory democracy), new political orientations (the renaissance of the Left in Latin America), and new missions for the military. Debate centres on the indicators to evaluate the level of consolidation of civilian control, the manner in which these indicators are measured, and the empirical ambiguities that arise. These challenges must be confronted in order to effectively address the question of how much progress has been made in the region in subordinating the military to civilian control, which countries are lagging behind, and why. Book excerpt: Scholars of Latin American politics have been challenged to account for the varied outcomes of the transitions from authoritarian to democratic government that have occurred in many countries south of the border during the past two decades. What explains why some transitions were relatively smooth, with the military firmly in control of the process, while others witnessed substantial concessions by the military to civilian leaders, or even total military collapse? Rather than focus on causes external to the military, such as the previous legacy of democratic rule, severe economic crisis, or social protest, as other scholars have done, Craig Arceneaux draws attention to the important variables internal to the military, such as its unity or ability to coordinate strategy. Using this &"historical-institutionalist&" approach, he compares five different transitions in Brazil and three countries of the Southern Cone&—Argentina, Chile, and Uruguay&—to show what similarities and differences existed and how the differences may be attributed to variations in the internal institutional structure and operation of the military.

Book excerpt: Argentina's recently established democracy endured the trauma of four major military uprisings between 1987 and 1990, continuing even after the rebels' original motivations faded. Exploring the causes of the rebellions and the rebel movement's development, Deborah L. Norden's Military Rebellion in Argentina underlines the inherently undefined nature of new democracies and reveals important dimensions of how coalitions are formed within the armed forces. By focusing on a military movement rather than merely separate incidents of insurrection, this study reveals central motivations that could be otherwise overlooked. Norden begins with an analysis of the relation between democracy and military insurrection in previous postauthoritarian civilian periods, then turns to Argentina's long battle against military intervention in politics. The study focuses on the internally divisive effects of the 1976-1983 military regime, which generated the intra-army cleavages that emerged during the subsequent period of civilian rule, and the civilian policies that prompted the rebels to action. At the heart of the study is an examination of the evolution of military rebellion, looking at the shift from policy-provoked reaction to more independent, politically motivated organization. Norden also explores general themes such as intransigent interventionism and the effects of different military regimes in South America on the likelihood of democratic consolidation. Deborah L. Norden is an assistant professor of government at Colby College. Her articles on Latin America have appeared in numerous journals.
