Book excerpt: Since 1970, when Charles Hamblin issued a challenge for philosophers, logicians, and educators in general to begin work anew in fallacies, a serious literature on fallacies has indeed developed. Part of this literature deals with the theory of what fallacies are; another part of it contains rigorous analyses of particular fallacies. However, most is still not readily accessible to the researcher, teacher, or student of the field. As a result, the best work on fallacies is not finding its way into the classroom, nor is it informing the educational and intellectual experiences available to most college and university students. A major purpose of this book is to make the post-Hamblin work on fallacies available to a wider audience in a single, convenient volume. The editors have brought together for the first time the most important historical writings on fallacy theory, from Aristotle to John Stuart Mill, and the most recent and most important theoretical and pedagogical developments in the field since Hamblin's landmark 1970 book. All but a few of the essays included are new contributions for this anthology, and an extensive annotated bibliography is included for researchers and students of fallacies and fallacy theory.

The actual state of the art in dialogue analysis is characterized by a tendency to overcome the distinction between competence and performance and to combine components from both sides of the dichotomy, in a way which includes rules as well as inferences. The same is true of rhetoric: the guidelines proposed here no longer state that rationality and persuasion are mutually exclusive but suggest that they interact in what might be called the 'mixed game'. The concept of a dialogic rhetoric thus poses the question of how to integrate the different voices. Part I of the volume assembles several 'rhetorical paradigms' which are applied to real-life performance. Part II on 'rhetoric in the mixed game' contains a selection of papers which illustrate the interaction of various components. The Round Table discussion in Part III brings proponents of different paradigms face to face with each other and shows how they justify their own positions and present arguments against rival paradigms.

In a systematic survey this study investigates what is at stake when truth is given up. A historical overview shows how the current problem of truth came about, and suggests ways to overcome rather than to repair the problem. A key issue resulting from the loss of truth is the lack of normativity. Truth provided an alternative understanding of normativity. Elaborating on the `dialectical shift' in logic, a dialogico-rhetorical understanding of normativity is presented. Rather than requiring truth, agreement, or rationality, dialogico-rhetorical normativity is the result of a balance of particular standards. This type of normativity is shaped within discussions - by advancing and accepting arguments - and is not located in sets of predetermined rules. The result is a `small' but strong form of normativity. If this understanding of normativity is viable, one of the central problems of contemporary philosophy, the problem of incommensurability, can be seen in a different light. As a result, truth reappears again. Surviving the postmodern criticisms, it is a matter of accountability rather than of description.

This book argues that we can learn a lot from how the courts have developed procedures over the years for allocating and reasoning with presumptions and burdens of proof, and from how artificial intelligence has built precise formal and computational systems to represent this kind of reasoning. The book provides a model of reasoning with burden of proof and presumption, based on analyses of many clearly explained legal and non-legal examples. The model is shown to fit cases of everyday conversational argumentation as well as argumentation in legal cases. Burden of proof determines (1) under what conditions an arguer is obliged to support a claim with an argument that backs it up and (2) how strong that argument needs to be to prove the claim in question.

It seemed to me that many of these uses of argumentation were inspired by (of ten inspired) guesswork, and that a great majority of the AI community were unaware that there was a maturing, rich field of research in Argumentation Theory (and Critical Thinking and Informal Logic) that had been steadily re building a scholarly approach to the area over the previous twenty years or so. Argumentation Theory, on its side; was developing theories and approaches that many in the field felt could have a role more widely in research and soci ety, but were for the most part unaware that AI was one of the best candidates for such application.

The meta-methodological assumption which unifies the research of this group, holds that there is a way to do philosophy which is a middle course between abstract normative philosophy of science and descriptive social studies of science. On the one hand it is argued with social studies of science that philosophy should take notice of what scientists actually do. On the other hand, however, it is claimed that philosophy can and should aim to reveal cognitive patterns in the processes and products of scientific and common sense knowledge. Since it is thought that those patterns can function as guidelines in new research and/or in research in other disciplines, philosophy can nevertheless hold on to the normative aim which is characteristic of 'classical' philosophy of science. Compared to this common assumption, there is a diversity of subjects. Some papers deal with general problems of science, knowledge, cognition and argumentation, others with topics relating to foundational problems of particular sciences. Therefore this volume is of interest to philosophers of science, to philosophers of knowledge and argumentation in general, to philosophers of mind, as well as for scientists working in the physical and applied sciences, biology, psychology and economy who are interested in the foundations of their disciplines.
