This book was released on 2016-04-08 with total page 120 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this commentary, Aoife Daly provides analysis of Article 15 of the UN Convention on the Rights of the Child – the right of children to freedom of association and assembly. Relevant international law text and case law are examined, but this commenary goes beyond this to reconceptualise Article 15. The right is applied to themes as varied as association with family and friends, political demonstrations, and the unionisation of working children, with the special position of children to the forefront of the analysis. Possibilities for progressing the right through UN mechanisms, courts and other arenas are considered. In doing so, this book pushes traditional boundaries to and understandings of association and assembly, drawing-out particularly child-specific elements of this crucial right.

Book The Aarhus Convention

Download or read book The Aarhus Convention written by Duncan Weaver and published by Springer Nature. This book was released on 2023-10-30 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Aarhus Convention on access to information, public participation in decision-making and access to justice in environmental matters has been celebrated as a pioneering international environmental agreement. Given that a quarter-century has passed since Aarhus was opened for signature, now is an opportune moment to revisit it from a fresh perspective. Marking this anniversary, this book explores Aarhus from the vista of the English School of International Relations, an ethically-minded perspective used to gauge the prevalence of state-oriented and human-oriented progress from the Convention's rationales and realities. It firstly considers Aarhus' propagation, investigating the legal, diplomatic and geopolitical contexts enabling its emergence. It secondly investigates Aarhus' germination, with reference to its trinity of procedural rights. Thirdly, the book examines the Convention's growth, in terms of the development of its organisational infrastructure. The chief finding is that Aarhus demonstrates, in environmental contexts, the feasibility and benefit of fostering 'humankind' solidarist progress, rooted in moral cosmopolitanism, within the existing power arrangements of a sovereignty-based pluralism. Pluralist concerns for diversity and international order are found to be a precondition for more ethically ambitious solidarist endeavours. These observations reinforce the logic of solidarisation, an English School innovation that presents sovereignty as (a) being ethically matured by solidarism whilst (b) delimiting solidarism within the threshold of states' tolerance.

Book excerpt: Human Action—a treatise on laissez-faire capitalism by Ludwig von Mises—is a historically important and classic publication on economics, and yet it can be an intimidating work due to its length and formal style. Choice: Cooperation, Enterprise, and Human Action, however, skillfully relays the main insights from Human Action in a style that will resonate with modern readers. The book assumes no prior knowledge in economics or other fields, and, when necessary, it provides the historical and scholarly context necessary to explain the contribution Mises makes on a particular issue. To faithfully reproduce the material in Human Action, this work mirrors its basic structure, providing readers with an enjoyable and educational introduction to the life's work of one of history's most important economists.

Book The International Convention on the Elimination of All Forms of Racial Discrimination

Download or read book The International Convention on the Elimination of All Forms of Racial Discrimination written by Patrick Thornberry and published by Oxford University Press. This book was released on 2016-07-14 with total page 576 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Convention on the Elimination of All Forms of Racial Discrimination is the centrepiece of international efforts to address racial discrimination, defined in broad terms to include discrimination based on race, colour, descent, or national or ethnic origin. Victims of discrimination within the scope of the Convention include minorities, indigenous peoples, non-citizens, and caste or descent groups. Virtually all national societies are diverse in terms of ethnicity or 'race' and none is free from discrimination, making it one of the great issues of our time. Against the background of international human rights standards and mechanisms to counter racial and ethnic discrimination, this book provides the first comprehensive legal analysis of the provisions of the Convention on an article-by article basis. The book addresses the place of the Convention within the broader framework of international action against discrimination. The different chapters analyse and discuss broad topics of race, ethnicity, and international law, the genesis and drafting of the Convention, the aims and objectives of the Convention in light of its preamble, and principles of non-discrimination and equality. In particular, the book includes a critical appraisal of the contribution of the Convention to the eradication of racial discrimination. It also reflects on whether there is scope for modification of the substance or procedures of the Convention in light of challenges arising from enhanced transnational population movements, the intersection between discrimination on the ground of race and discrimination against religious communities, and the intersection of racial and gender-based discrimination.
