An emerging set of new problems in the law of international trade is how to reconcile the rules of the multilateral trading system with shortages of certain natural resources and the necessity to develop renewable energy resources. The chapters in this book provide a comprehensive analysis of the international trade issues presented by national trade laws and policies with regard to natural resources and energy. This book is about the extent to which we are interpreting existing rules to cover emerging problems and how the rules of the multilateral trading system can be adapted to achieve sustainable development in natural resources and energy. The book begins with a survey of selected national laws relating to recent restrictions on the export of natural resources, both resources used to produce energy as well as natural resources essential for industrial production. After examining the range of such laws in selected important countries, we turn to the application of the rules of the multilateral trading system to such export restrictions. We discuss the major rules of the World Trade Organization (WTO) as well as the natural resources rules in selected regional preferential free trade agreements. While there is not a comprehensive global legal regime on competition law, we believe it is also important to examine how selected national competition laws impact export restrictions on natural resources. This book will be a major contribution to the international dialogue on international economic law issues with respect to trade in natural resources and energy.

Aside from the projected doubling of food consumption in the next fifty years, the growing trade of biofuels and other commodities is a global challenge as the economic activities in the primary sector (i.e. mining, fisheries, aquaculture, forestry and agriculture) can damage biodiversity and ecosystem services. This should be taken into account in the decision-making affecting the global value chains linking consumer, retailer, processor, and producer in the North and the South. To cover the topic of ecosystem services and global trade this book is organized into four major parts. Part 1 gives the theoretical framework from an ecological, economic and political perspectives. Part 2 explores how internationally traded biophysical commodities from agriculture, forestry and fisheries translates into a virtual flow of land, freshwater, and marine ecosystems. Part 3 describes how two widely used accounting tools (i.e., Life Cycle Assessment and Green National Accounts) deal with international aspects of ecosystem services, and Part 4 shows how instruments like labelling, bans, or payments for ecosystem services in the private and public sector can influence trade patterns and the management of ecosystem services. This collection is a valuable contribution to the global change science dealing with ecosystem services. It illustrates the consequences of international trade on global ecosystem services and provides an overview of accounting tools and of market-based policy instruments to address negative and positive externalities. The book is certainly innovative, because it brings together research findings from distinct disciplines especially Industrial Ecology and Ecosystem Sciences, as well as Environmental Economics and Political Science.

Book excerpt: In general, a reduction in trade barriers will affect the environment by expanding the scale of economic activity, by altering the composition of economic activity and by initiating a change in the techniques of production. We present empirical evidence to assess the relative magnitudes of these three effects as they apply to further trade liberalization in Mexico. We first use comparable measures of three air pollutants in a cross-section of urban areas located in 42 countries to study the relationship between air quality and economic growth. We find for two pollutants (sulphur dioxide and 'smoke') that concentrations increase with per capita GDP at low levels of national income, but decrease with GDP growth at higher levels of income. We then study the determinants of the industry pattern of US imports from Mexico and of value added by Mexico's maquiladora sector. We investigate whether the size of pollution abatement costs in US industry influences the pattern of international trade and investment. Finally, we use the results from a computable general equilibrium model to study the likely compositional effect of a North American Free Trade Agreement (NAFTA) on pollution in Mexico.

This study focuses on the nexus of five essential natural resources: land, food, energy, water, and minerals. This report provides insight into the complex interaction between resource supply and demand, global megatrends such as economic growth, climate change, urbanization and demographics, and broader nexus variables such as human resources, technology, governance, social and political factors and instability. Comprising case studies on soy from Brazil, cocoa from Côte d’Ivoire and palm oil from Malaysia, the report illustrates how the nexus dynamics create various risks to the sustainable security of supply of agricultural commodities that are of high importance to the Dutch agri-food sector. The results of this research can be used to strengthen existing initiatives for sustainable supply chain management, and to facilitate policy making in this field. To this end, the report contains a chapter with recommendations on how policymakers can use the global resource nexus framework proposed in this report.

Book excerpt: Arguments for protection and against free trade have seen a revival in developed countries such as the United States and Great Britain as well as developing countries such as India. Given the clear benefits trade openness has brought everywhere, this is a surprising development. The benefits of free trade are especially great for emerging market economies. Free Trade and Prosperity offers the first full-scale defense of pro-free-trade policies with developing countries at its center. Arvind Panagariya, a professor at Columbia University and former top economic advisor to the government of India, supplies a historically informed analysis of many longstanding but flawed arguments for protection. He starts with an insightful overview of the positive case for free trade, and then closely examines the various contentions of protectionists. One protectionist argument is that "infant" industries need time to grow and become competitive, and thus should be sheltered. Other arguments are that emerging markets are especially prone to coordination failures, they are in need of diversification of their production structures, and they suffer from market imperfections. The panoply of protectionist arguments, including those for import substitution industrialization, fails when subject to close logical and empirical scrutiny. Panagariya provides compelling evidence demonstrating the failures of protectionism and the promise of free trade using detailed case studies of successful countries such as Singapore, Taiwan, South Korea, China and India. Low or declining barriers to free trade and high or rising shares of trade in total income have been key elements in the sustained rapid growth and poverty alleviation in these countries and many others. Free trade is like oxygen: the benefits are ubiquitous and not noticed until they are no longer there. This important book is an essential reminder of the costs of protectionism.
