Over the past few decades a range of alternative, dispute resolution programmes have emerged to settle conflicts informally, outside the courtroom. Drawing on real life experiences of community mediation practices in British Columbia, Canada, the author explores informal justice as an event rendered possible by the fragmentation of justice under postmodern conditions. He develops some of Foucault's ideas on governmentality to erect an analytical framework that does not view community mediation as necessarily empowering, or an inevitable expansion of state control. The analysis identifies how one might engage with current versions of community justice and yet avoid the political apathy that too often accompanies such criticism.

In this book, Yue Zhang presents a cross-national comparative analysis of the politics of urban preservation. Based on comprehensive archival research and more than two hundred in-depth interviews in Beijing, Chicago, and Paris, Zhang finds that urban preservation provides a tool for diverse political and social actors to frame their propositions and advance their favored courses of action. In cities from West to East, divergent political and economic interests have caused urban preservation to become contested. Exploring three of the world’s great cities, Zhang deftly navigates readers through each case study, illustrating the complexities of the politics of urban preservation in each city. In Beijing, urban preservation was integral to promoting economic growth and enhancing the city’s image during the lead-up to the 2008 Olympics; in Chicago, it is used to increase property values and revitalize neighborhoods; and in Paris, it offers a channel for national and municipal governments to compete for control over urban space. Book excerpt: In the two related works in this volume, Bentham offers a detailed critique of William Blackstone's Commentaries on the Laws of England (1765-9). In 'Comment on the Commentaries', on which Bentham began work in 1774, he exposes the fallacies which he claims to have detected in Blackstone, and criticizes the theory of the Common Law. He goes on to provide important reflections on the nature of law, and more particularly on the nature of customary and of statute law, and on judicial interpretation. A Fragment on Government, which was published in 1776, was detached from the 'Comment on the Commentaries'. Concentrating on a passage of five or six pages in which Blackstone discusses the origin of society and government, Bentham offers three main criticisms. First, he criticizes Blackstone's methodology for failing to distinguish between the role of the expositor and the role of the censor, and thereby confusing the question of what the law is with the question of what the law ought to be. Second, he criticizes Blackstone's assumption that the theory of the social contract represents an adequate justification of the obligation to obey government. Third, he criticizes Blackstone's theory of sovereignty, which claims that in every state there must exist some absolute, undivided power, whose commands are law. Bentham points to the existence of states where sovereign power is both divided and limited. In these two works, published by OUP for the first time, Bentham outlines a number of themes which he goes on to develop in his later works: the principle of utility; the importance of a 'natural arrangement' for a legal system; the point at which resistance to government becomes justifiable; the exposition of legal terms; and much more. The volume also contains Bentham's 'Preface' intended for, but not published in, the second edition of A Fragment on Government, which appeared in 1823. Having by this committed himself to political radicalism, Bentham uses this occasion to reflect on the text and the circumstances in which it was produced. The text has been edited by H.L.A. Hart and J.H. Burns, whose reputations in their respective fields of legal theory and history of political thought are unsurpassed. The volume contains an Editorial Introduction which explains the provenance of the text, and the method of presentation. The texts are fully annotated with textual and historical notes, and the volume is completed with a detailed subject index, based on a methodology devised by Hart.

Book excerpt: An examination of how the (hyper)local is the locus of real change Many of America’s downtowns, waterfronts, and innovation districts have experienced significant revitalization and reinvestment in recent years, but concentrated poverty and racial segregation remain persistent across thousands of urban, suburban, and rural neighborhoods. The coronavirus pandemic magnified this sustained and growing landscape of inequality. Uneven patterns of economic growth and investment require a shift in how communities are governed and managed. This shift must take into account the changing socioeconomic realities of regions and the pressing need to bring inclusive economic growth and prosperity to more people and places. In this context, place-based (“hyperlocal”) governance structures in the United States and around the globe have been both part of the problem and part of the solution. These organizations range from community land trusts to business improvement districts to neighborhood councils. However, very little systematic research has documented the full diversity and evolution of these organizations as part of one interrelated field. Hyperlocal helps fill that gap by describing the challenges and opportunities of “place governance.” The chapters in Hyperlocal explore both the tensions and benefits associated with governing places in an increasingly fragmented—and inequitable—economic landscape. Together they explore the potential of place governance to give stakeholders a structure through which to share ideas, voice concerns, advocate for investments, and co-design strategies with others both inside and outside their place. They also discuss how place governance can serve the interests of some stakeholders over others, in turn exacerbating wealth-based inequities within and across communities. Finally, they highlight innovative financing, organizing, and ownership models for creating and sustaining more effective and inclusive place governance structures. The authors hope to provoke new thinking among place governance practitioners, policymakers, private sector leaders, urban planners, scholars, students, and philanthropists about how, why, and for whom place governance matters. The book also provides guidance on how to improve place governance practice to benefit more people and places.
