Download or read book The Counsel of Rogues written by Tim Dare and published by Routledge. This book was released on 2016-03-16 with total page 182 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is a widespread perception that even when lawyers are acting squarely within their roles, being good lawyers, they display the vices of dishonesty and deviousness. At the heart of the perception is the so called standard conception of the lawyer’s role according to which lawyers owe special duties to their clients which render permissible, or even mandatory, acts that would otherwise count as morally impermissible. Many have concluded that the standard conception should be set aside. This book suggests that the moral implications of the standard conception are often mischaracterised. Critics suggest that the conception requires lawyers to secure any advantage the law can be made to give. But Dare offers a moral argument for the conception, according to which it justifies a more limited and moderate sphere of professional conduct than is normally supposed, allowing lawyers to preserve their integrity while giving proper weight to the role-differentiated permissions and obligations of their roles.

Download or read book The Rise of Transparency in International Arbitration written by Alberto Malatesta and published by Juris Publishing, Inc.. This book was released on 2013-08-01 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Rise of Transparency in International Arbitration is inspired by a joint research conducted in the last years by the Milan Chamber of Arbitration and the Law School of the University Carlo Cattaneo–LIUC, Castellanza, in Italy. The two bodies have shared a common concern in order to increase the use of international commercial arbitration and to develop a proper culture in the field: the need for enhancing transparency and especially for a wider dissemination of arbitral awards. The advantages of arbitration as the main alternative means of dispute resolution are well known and undisputed. Privacy and confidentiality are among them and at the same time among the prevailing features of any arbitral proceedings. However, sometimes users have the feeling to deal with a close and too slow-growing world. The need, if not the request, for a greater accountability of the arbitral world in the whole is more and more widespread. In this context the aim of this book is on the one hand to spur discussion and to shed new light on the traditional idea of confidentiality in international commercial arbitration (and in some other figures alike). Although this idea is sometimes founded upon sound reasons that cannot be ignored or totally set aside, it must be reconsidered by taking into account the rise of transparency. On the other hand, a specific proposal is made in order to step ahead from the current situation, with particular reference to the issue of the publication of the awards. In this respect, the main outcome is the Guidelines for the Anonymous Publication of Arbitral Awards, already adopted and experienced by the Milan Chamber. They are addressed to institutions, practitioners, scholars with the goal to favor the circulation of the awards and of the related decisions.

Download or read book Mechanisms for CO2 Sequestration in Geological Formations and Enhanced Gas Recovery written by Roozbeh Khosrokhavar and published by Springer. This book was released on 2015-10-28 with total page 106 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book gives background information why shale formations in the world are important both for storage capacity and enhanced gas recovery (EGR). Part of this book investigates the sequestration capacity in geological formations and the mechanisms for the enhanced storage rate of CO2 in an underlying saline aquifer. The growing concern about global warming has increased interest in geological storage of carbon dioxide (CO2). The main mechanism of the enhancement, viz., the occurrence of gravity fingers, which are the vehicles of enhanced transport in saline aquifers, can be visualized using the Schlieren technique. In addition high pressure experiments confirmed that the storage rate is indeed enhanced in porous media. The book is appropriate for graduate students, researchers and advanced professionals in petroleum and chemical engineering. It provides the interested reader with in-depth insights into the possibilities and challenges of CO2 storage and the EGR prospect.
