Así, a partir del estudio del Decreto 1082 de 2015, reglamentario del Estatuto General de la Contratación de la Administración Pública (que derogó por completo lo establecido en el Decreto 734 de 2012 y compiló lo dispuesto en el Decreto 1510 de 2013), del análisis de la jurisprudencia administrativa, y del examene de los laudos arbitrales, que han sido dinámicos y hasta, en algunas ocasiones. cambiantes frente a las tesis expuestas en la pasada edición, a la luz del derecho se constata que la figura de los contratos estatales posee sustantividad propia, por lo que merece el desarrollo particular que aquí se les da, incluyendo un capítulo referido a su equilibrio económico, una de las principales vicisitudes que se presenta a lo largo de su ejecución y que comporta, sin duda, un aspecto vital y álgido de la contratación estatal.

Book excerpt: A partir del acto de adjudicación, en el evento en que se haya efectuado un procedimiento de selección de naturaleza concursal, o de la determinación de contratar con el oferente que haya presentado la mejor propuesta en los casos de contratación directa que prescinden de dicho procedimiento, se sigue entonces a la elaboración y perfeccionamiento del contrato estatal. Esta fase, de acuerdo con el sistema adoptado por el legislador, implica agotar un conjunto de etapas que no solamente determinarán la existencia del mismo, sino además la posibilidad de iniciar la ejecución del objeto solicitado por la Administración, así como la inclusión de todos los aspectos necesarios para regular el objeto y la contraprestación en el mismo, con el único límite en la ley, el orden público, el interés general, los principios de buena administración y las finalidades de la contratación estatal. Esto ha sido denominado por la doctrina como la forma y las formalidades del contrato, uno de los temas más importantes en la contratación del Estado en la actualidad, y que más allá de los lineamientos propios de la naturaleza de lo que se pretende contratar, conlleva todo un marco de ritualidades específicas que determinan la existencia misma del acuerdo entre las partes, al punto que en su ausencia se hace imposible la aplicación íntegra de la teoría de los contratos y, por ende, debe buscarse otro tipo de justificación para la continua y eficiente prestación del servicio público, por una parte, y para el provecho económico y estructuración de la relación creada entre el Estado y el particular que busca satisfacer la necesidad de prestación o expectativa de remuneración, por la otra.
