Participation is almost universal. The rules giving special protection to ambassadors are the oldest established in international law and the Convention is respected almost everywhere. But understanding it as a living instrument requires knowledge of its background in customary international law, of the negotiating history which clarifies many of its terms and the subsequent practice of states and decisions of national courts which have resolved other ambiguities. Diplomatic Law provides this in-depth Commentary. The book is an essential guide to changing methods of modern diplomacy and shows how challenges to its regime of special protection for embassies and diplomats have been met and resolved. Book excerpt: This work examines which Soviet Bloc practices were considered in the creation and drafting of the Foreign Missions Act (FMA) and how these have been taken into consideration in attempting to achieve reciprocity with those countries' missions in the US. Other topics are discussed are: The origins of the FMA, the history of the FMA, the rationale behind the Office of Foreign Missions, (OFM) the mechanism created by the FMA, what influence Soviet Bloc methods had upon the structure of the OFM, and the successes the OFM has had in achieving reciprocity. This work is divided as chronologically as the discussion permits into three sections. The first explains who supported and who opposed the FMA. It also describes the rationale for the formation of the OFM. The second section discusses the various sections of the FMA. It also describes how the FMA is being implemented in some key areas.
