Limitati, sia per la ristretta cernita di argomenti trattati rispetto al vastissimo contenuto del diritto pubblico romano, esteso in un ambito temporale di circa tredici secoli (dalla metà circa dell’VIII secolo a.C. – alla morte di Giustiniano nel 565 d.C.), sia per la sua finalità prettamente didattica, che porta a semplificare al massimo i discorsi omettendo le numerose discussioni dottrinarie ed i riferimenti bibliografici. Ambiziosi, perché vorrebbero suscitare stimoli di riflessione nei discenti su certe radici storiche degli ordinamenti pubblicistici moderni, cogliendone spunti di comparazione, a riprova che non poche problematiche degli Stati moderni si trovano già nella lunga esperienza giuridica romana, anche se spesso con soluzioni diverse, e che le indagini storiche su di esse non devono avere come unico momento iniziale quello bassomedievale o quello della formazione degli Stati nazionali nel XVII-XVIII secolo. Nell’auspicio che si possano realizzare, almeno in parte, questi più ambiziosi obiettivi, ho inserito alcuni precisi riferimenti a istituti, principi e regole pubblicistiche moderne, senza con questo voler operare alcun “salto” dal diritto romano a quello contemporaneo, omettendo il ruolo fondamentale e indispensabile svolto dal diritto “intermedio” e proto-moderno. Ho semplicemente pensato che potesse essere utile per chi intraprende una formazione giuridica conoscere punti di partenza e di arrivo di determinati concetti, comprendendo così l’importanza di collocarli nel loro svolgimento storico. Sempre con il medesimo auspicio ho lasciato, soprattutto in nota, stringati richiami alle fonti antiche per quanti volessero leggerle direttamente ed approfondirne i contenuti. L’esposizione ricalca quella del mio Corso di diritto pubblico romano, già sperimentato da un decennio, con la suddivisione però in tre sole parti: la prima sulle forme di governo e sulla creazione di un apparato amministrativo, la seconda sulle fonti del diritto e la terza, infine, sul diritto penale, internazionale, amministrativo e finanziario. In ognuna mi sono proposto di trattare gli argomenti, a mio avviso, più seducenti per un futuro giurista: l’evoluzione di un sistema costituzionale non scritto; la pluralità e specificità delle fonti del diritto; la convivenza fra più piani ordinamentali all’interno di un ordinamento che resta comunque unitario; l’idea di codificazione e la sua attuazione concreta; taluni fondamenti del diritto penale e le garanzie riconosciute in sede del relativo processo; i rapporti internazionali; le forme di organizzazione territoriale, le questioni connesse alla concessione della cittadinanza, le strutture del sistema fiscale.

Book excerpt: The principle of solidarity is particularly important now because it is in juxtaposition to some current self-centered trends in politics: the crises that have upset the world in recent years, such as migrations, hegemonic aspirations, pandemics, and wars, have made self-evident the inadequacy of such selfish politics. It therefore seems very useful to understand the role that solidarity could play in contemporary scenarios. This book thus collects various contributions on the principle of solidarity in international law. Firstly, it reconstructs the foundations of solidarity in law and investigates the origins of the principle. Subsequently, it tries to ascertain if solidarity exists as a principle in international law and, if so, what its scope is. The book then examines the eventual implementation of the principle of solidarity in regional organizations law: the question is whether solidarity is more effective and if it is actually better fulfilled when relationships between states get stronger, such as in regional and sub-regional organizations. Such implementation is notable in EU Law, but the analysis also involves other regional and sub-regional organizations, namely the African Union, ECOWAS, the League of Arab States, and MERCOSUR. This book takes into account not only some distinctive areas of solidarity, such as migration law, or specific institutional contexts where solidarity is a declared principle, objective or value, for example, the European Union, but it also considers whether, and to what extent, the manifestations of solidarity differ in disparate settings, trying to discover the reasons behind such divergences. The book will be of interest to researchers and academics in the areas of International Law, International Organizations Law, European Law, Human Rights Law, Business Law, and Constitutional Law.
