Book excerpt: The material contained in this publication is the outcome of the 8th International Conference on Human Rights "Right to Knowledge and Information in Heterogenic Society", organized by the Faculty of Law and Administration in the University of Warmia and Mazury in Olsztyn (Poland), in cooperation with the Faculty of Law in the University of Bari (Italy), which took place on 30-31 May 2008 in Olsztyn. The selection of issues in no respect can be called accidental. The summit of the European Council in Lisbon in March 2000 created foundations for creating society based on knowledge that is conscious in gaining information and equal access to knowledge. Individual actions of countries should aim at creating a human-friendly "information society" which allows creation of new working places and developing information and telecommunication technologies. This broad spectrum of problems which were the subject of the conference, interests not only Polish researchers but also scientists from countries like Italy, Spain, Ukraine, the United States of America, United Kingdom, and South Korea. They represent various cultures, which implies differences of opinion on many issues related to human rights. Publications included in this collective work are the reflection of freedom to express thoughts on difficult topics, which are important for all though.

Book excerpt: With the promulgation of the motu proprio Mitus iudex Dominus Jesus for the Latin Church and the motu proprio Mitis et misericors Jesus for the Eastern Catholic Churches, both dated August 15, 2015, Pope Francis addressed the calls during the Third Extraordinary General Assembly of the Synod of Bishops (October 5-19, 2014) for a simplified procedure for the declaration of the nullity of marriages. Pope Francis introduced a briefer process to be conducted by the diocesan bishop and he simplified the current ordinary nullity process. The new procedural norms went into effect on December 8, 2015. New legislation always challenges first and foremost the practitioner: how is the new legislation to be understood and applied? Immediately after the new law was made public, a number of articles on this new legislation were published in The Jurist. The School of Canon Law of The Catholic University of America organized a March 2016 Workshop on the very topic of this important procedural reform. These articles are now brought together in one volume to assist those who work with these norms in the various tribunals dealing with marriage cases. It is hoped that this volume will be of great service to all those who serve the people of God in the ministry of justice, and that these contributions will truly be a help in understanding and applying the new norms.

Book excerpt: The ordinary episcopal visitation of parishes, treated in canons 396-398 of the 1983 Code of Canon Law, is studied here from its origins to the present. The dissertation’s first chapter traces the historical development of this ancient canonical institute, particularly with a view to showing its usefulness for Church reform. The second examines the canons of the 1917 and 1983 codes and provides a detailed commentary on the latter. A final chapter studies the visitation of parishes in Canada. Three methods are used, corresponding to the three chapters. In the first chapter, a primarily historical review draws on Scripture, the Fathers, papal legislation, the decrees of provincial and ecumenical councils (particularly the Council of Trent), and other sources. The second chapter takes an exegetical approach, interpreting the 1983 canons on the visitation in light of the former law, the Second Vatican Council, and contemporary papal and curial documents. The visitation is related to the diocesan bishop’s power of governance. The third chapter presents the results of the author’s survey of Canadian bishops, carried out according to the methods of social science research. Without arguing that the visitation is a panacea for all the Church’s ills, the author concludes that it is a highly effective way for bishops to address some present difficulties and avoid future ones.
