The United Nations Convention on the Law of the Sea comprehensively defined the parameters of the law of the sea in 1982, and since the Convention was concluded it has seen considerable development. This Oxford Handbook provides a comprehensive and original analysis of its current debates and controversies, both theoretical and practical. Written by over forty expert and interdisciplinary contributors, the Handbook sets out how the law of the sea has developed, and the challenges it is currently facing. The Handbook consists of forty chapters divided into six parts. First, it explains the origins and evolution of the law of the sea, with a particular focus upon the role of key publicists such as Hugo Grotius and John Selden, the gradual development of state practice, and the creation of the 1982 UN Convention. It then reviews the components which comprise the maritime domain, assessing their definition, assertion, and recognition. Book excerpt: The publication documents the results of the review of the level of implementation of the FAO Ecosystem Approach to Fisheries (EAF) by the fisheries management bodies in each of the different ABNJ regions. The review was designed to help identify future activities by the ABNJ Deep Sea Project to address gaps and capacity development and make recommendations to strengthen EAF among deep-sea fisheries management bodies and/or their members. The information to complete the EAF reviews was largely obtained from web-based materials. To assist with the accuracy of these desktop assessments, following initial drafting of each EAF background report and associated EAF assessment, both documents were sent to the respective RFMO secretariats. Comments and/or suggestions provided by the secretariats were then addressed with revised versions of the background reports and review assessments generated. Based on these revised reports, the comparative analyses were finalized and a full report was drafted. Being a desk-top assessment of the level of implementation of the EAF approach by each of the RFMO management bodies, the study had a number of caveats including only being able to measure systems and processes, not outcomes. A more complete assessment of EAF adoption and especially the outcomes would require direct involvement of the various stakeholders, including all relevant management, compliance and scientific bodies, contracting parties (CP), non-contracting parties (NCP), vessel owners, crews, non-governmental organizations (NGOs), etc.

Regional fisheries management organisations, in whose gift participatory rights increasingly lie, are perceptibly shifting their attention to this approach, which has hitherto been little analysed; this book provides a review of the practice of these bodies and the States that are their members. The recently favoured response of governments, combating 'IUU' - illegal, unregulated and unreported - fishing, is shown to rest on a flawed concept, and the solution might lie less in law than in legal policy: compulsory dispute settlement to moderate their claims and an expansion of the possibilities of trading of quotas to make solving the global overcapacity issue easier.
