Book excerpt: The book covers the period from 1812, when the Tron Riot in Edinburgh dramatically drew attention to the ‘lamentable extent of juvenile depravity’, up to 1872, when the Education Act (Scotland) inaugurated a system of universal schooling. During the 1840s and 1850s in particular there was a move away from a punitive approach to young offenders to one based on reformation and prevention. Scotland played a key role in developing reformatory institutions – notably the Glasgow House of Refuge, the largest of its type in the UK – and industrial schools which provided meals and education for children in danger of falling into crime. These schools were pioneered in Aberdeen by Sheriff William Watson and in Edinburgh by the Reverend Thomas Guthrie and exerted considerable influence throughout the United Kingdom. The experience of the Scottish schools was crucial in the development of legislation for a national, UK-wide system between 1854 and 1866.

Book excerpt: Despite the widely held belief that the social services were allocated solely on the basis of client need, and could therefore be directly contrasted with the operation of the private market, in the 1970s there remained a wide range of services for which the consumer had to pay directly at the time of consumption. Consumer charges were widely used, for example, for residential accommodation, for the provision of day care and for domiciliary services. Originally published in 1980, Charging for Social Care provided a long overdue examination of the use of these charges in the personal social services. It analyses their historical origins, current operation and their social and financial significance. In addition, it provides a clear theoretical framework within which pricing policies should be determined and outlines the policy for pricing personal social services in the future. In undertaking this analysis Ken Judge and James Matthews had gone beyond the rhetoric which in the past had characterised discussions about charges. Their detailed and perceptive study was based on a report for the Department of Health and Social Security. It would still be of interest to students and teachers of social policy and social administration, to policy makers in both central and local government, to students of the economics of social policy and of the public sector, to social workers, and to all those with an interest in the personal social services and in public spending decisions.

It charts the emergence of the system from the mid-nineteenth century to the present. From the beginning, the system was dominated by a large network of reformatory and industrial schools which incarcerated tens of thousands of children and remained in existence into the late twentieth century. This dominance was eventually challenged by emerging discourses which emanated from the psychological sciences, social work, youth work and the children’s rights movement. The book draws from a wide range of official and unofficial sources in exploring the key rationalities underpinning the system. In adopting a governmentality approach, it also examines the technologies and forms of childhood identity that are employed to govern the child and young person within the context of the Irish juvenile justice system. Book excerpt: In recent years, social and legal historians have called into question the degree to which the labour that fuelled and sustained industrialization in England was actually ’free’. The corpus of statutes known as master and servant law has been a focal point of interest: throughout the eighteenth and nineteenth centuries, at the behest of employers, mine owners, and manufacturers, Parliament regularly supplemented and updated the provisions of these statutes with new legislation which contained increasingly harsh sanctions for workers who left work, performed it poorly, or committed acts of misbehaviour. The statutes were characterized by a double standard of sanctions, which treated workers’ breach of contract as a criminal offence, but offered only civil remedies for the broken promises of employers. Surprisingly little scholarship has looked into resistance to the Master and Servant laws. This book examines the tactics, rhetoric and consequences of a sustained legal and political campaign by English and Welsh trade unions, Chartists, and a few radical solicitors against the penal sanctions of employment law during the mid-nineteenth century. By bringing together historical narratives that are all too frequently examined in isolation, Christopher Frank is able to draw new conclusions about the development of the English legal system, trade unionism and popular politics of the period. The author demonstrates how the use of imprisonment for breach of a labour contract under master and servant law, and its enforcement by local magistrates, played a significant role in shaping labour markets, disciplining workers and combating industrial action in many regions of England and Wales, and further into the British Empire. By combining social and legal history the book reveals the complex relationship between parliamentary legislation, its interpretation by the high courts, and its enforcement by local officials.
