Book excerpt: The parliaments of the Nordic EU member states are similar in that they all exercise a particularly robust style of oversight of their respective governments' conduct of EU affairs: compared to other national parliaments in the EU, they exemplify a common "Nordic model" of parliamentary scrutiny. However, important differences emerge when one compares the parliaments of Denmark, Sweden, Finland and Norway (a non-EU-member) in how they engage directly with the EU, through direct interaction with EU-level institutions and with other national parliaments regarding EU affairs. These differences may be illustrated by comparing their actions in response to one controversial EU legislative proposal, the 2012 Monti II Regulation concerning the right to strike, which was widely seen as hurtful to the interests of workers in Nordic countries. The Monti II proposal was the first EU legislative proposal to be withdrawn, under a new "Early Warning Mechanism" procedure, after objections to it were raised by numerous national parliamentary chambers, including those of Denmark, Sweden, and Finland. This process revealed important differences in the approach of the Nordic parliaments to the EU: they may be characterized variously as strategic coordinator (Danish Folketing), comprehensive scrutinizer (Swedish Riksdag), reluctant cooperator (Finnish Eduskunta), and outside-insider (Norwegian Storting).

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. Much of the literature, however, has focused on parliamentary scrutiny and control in EU affairs. What tends to be generally overlooked is that the parliamentary communication function is at least as important in EU politics as the control function. Democratic legitimacy depends on a vibrant public debate on political solutions and alternatives to allow citizens to make informed political (electoral) choices and to exercise democratic control. Within the EU, it is precisely the opacity of policy-making processes and the lack of public discourse that have been defined as core problems of democratic legitimacy. Here, parliaments have the potential to provide an ideal arena for the deliberation of important European issues and thus to help overcome the much-lamented distance between European policy processes and the citizens. Yet, despite parliaments' central relevance for the legitimacy of European politics, the parliamentary communication function remains so far under researched. The volume aims at filling this gap by providing both qualitative and quantitative comparative data on various communication efforts by national parliaments. Empirical studies on the domestic impact of Europe identified different forms of Europeanization due to alternative mechanisms of internalising the new norms and rules. Although many studies have since focused on the question of how, to what degree, in what direction, at what pace, and at what point of time "Europe matters", the Europeanization of one particular structural determinant of the Member States, namely the system of parliamentary democracy, is still under-researched. This is all the more astonishing as democracy in the EU depends to a large extent on the democratic legitimacy of procedures at the national level. This volume addresses the key issue of the Europeanisation of parliamentary systems and thus contributes to the ongoing debate on the parliamentary dimension of the European Union.
