Book excerpt: This white paper and draft Bill present more detailed proposals for financial regulation reform following on from the consultation paper 'A new approach to financial regulation: judgment, focus and stability' (July 2010, Cm. 7874, ISBN 9780101787420); 'A new approach to financial regulation: building a stronger system' (May 2011, Cm. 8012, ISBN 9780101801225) and continuing policy development by the Treasury, Bank of England and Financial Services Authority. Responsibility for financial stability will rest within the Bank of England, in a new macroprudential body, the Financial Policy Committee, and a new micro-prudential supervisor, the Prudential Regulation Authority. Responsibility for conduct of business will sit with the new Financial Conduct Authority, with the mandate and tools to be a proactive force for enabling the right outcomes for consumers and market participants, including through the promotion of competition. Final responsibility for the overall regulatory framework, and the protection of the public finances remains with the Treasury, and the Chancellor of the Exchequer. An Independent Commission on Banking has also been established to consider what steps should be taken to deal with systemically important banks, alongside the question of whether and how competition in the banking sector should be improved. The Commission proposes: that the most systemically important banks hold additional capital to the Basel III minimum, to make them better at absorbing losses and less likely to fail; 'bail-in' instead of bail-out - so that private investors, not taxpayers, bear the losses if things do go wrong; and putting a ring-fence around high street banking to make it safer and to make it easier to allow a bank to fail without disrupting crucial banking services.

This special issue collects contributions from leading scholars who scrutinize the challenges digital finance presents for the EU internal market and financial market regulation from multiple public policy perspectives. The Governor of the Bank of England's concern is that 'people are trying to get to an end point too quickly'. The Government's reforms are taking place at a time when major changes are being proposed internationally. It is important that the United Kingdom, with a particularly large share of the financial services activity of the EU, secures proper representation on the EU regulatory bodies. The Government has set up an Independent Commission on Banking, to look at competition in banking, with a remit which could include radical structural reforms, due to report in the autumn. The Government also proposes to give a Financial Policy Committee (FPC), based in the Bank of England, power to monitor the system to ensure financial stability, and to take action when that stability is threatened. The Government further proposes to establish a prudential regulator, the Prudential Regulation Authority, as a subsidiary of the Bank of England. The Consumer Protection and Markets Authority (CPMA) will regulate the conduct of financial institutions. The financial crisis has resulted in a sharp increase in the direct costs of regulation. The indirect costs have doubtless increased further, although they remain difficult to quantify. Both are borne by the consumer. The Treasury Committee is concerned that the proposals say little about the cost of regulation, or about the non-bank sector. Regulatory changes should not be considered without proper evaluation of both their direct and indirect costs.

This book brings together strands of scholarship from law, economics, and political science to explore two key themes: the influence of economic evidence on the discretionary assessments of economic regulators, and the limits of judicial review of economic evidence, supplemented with comparative examination of both UK and US systems. In light of the challenges posed by economic evidence, Mantzari argues the appropriate scope of judicial review in the era of regulatory economics, and what the optimal institutional response to the pervasiveness of economic evidence in regulation should be. Building on comparative institutional analysis, this book rejects single-factor explanations, such as the individual knowledge of judges, in favour of a richer set of macro and micro-level factors that shape the relationships between courts and regulators.
