El enfoque de este simposio era muy amplio, como se refleja en las contribuciones que se presentan en este volumen, las cuales abordan temas tan diversos como las conexiones entre la ética material de los valores de inspiración fenomenológica y la idea de Derecho natural, la distinción esfera de lo jurídico/esfera de lo moral, las críticas a la consideración de los derechos humanos como fundados en la ley natural, los motivos por los que tenemos ciertos hechos y deberes como consecuencia de actos sociales, el sentido y significado del término libertad cuando este es empleado en el marco del Derecho penal, o el examen de ciertas concepciones que pretenden reducir la Filosofía del Derecho a una serie de cuestiones psicológicas, sociales o históricas cuando, en realidad, ésta depende de una discusión sobre cuestiones de principios y no de una mera comprobación de hechos. Sin embargo, a pesar de la diversidad de los trabajos que conforman este volumen, puede decirse que son dos los aspectos fundamentales que éstos comparten: por un lado, la necesidad de fomentar el diálogo entre disciplinas diferentes como la Filosofía y el Derecho en torno a una cuestión central, a saber, la existencia de elementos pre-positivos, anteriores a toda legislación positiva y, por otro lado, la convicción de que estos elementos tienen una inteligibilidad propia. *** Der Ursprung des vorliegenden Bandes ist ein im Mai 2015 vom Instituto Cultura y Sociedad der Universität von Navarra veranstaltetes Symposium. Wie die verschiedenen Beiträge zeigen, war die Bandbreite des Symposiums sehr weit gefasst. So wurden Themen behandelt wie die Zusammenhänge zwischen der phänomenologischen materialen Wertethik und der Idee des Naturrechts, die Unterscheidung zwischen der sittlichen und der rechtlichen Sphäre, die Kritik an denjenigen Theorien, die die Menschenrechte im Naturrecht verorten, die Motive, die uns dazu veranlassen, gewisse Tatsachen und Pflichten als Folgen sozialer Akte zu betrachten, der Sinn des Wortes „Freiheit“ im Rahmen des Strafrechts oder die kritische Prüfung derjenigen Auffassungen, die die Rechtsphilosophie auf eine Reihe von psychologischer, sozialer bzw. historischer Fragen zu reduzieren versuchen, wenn sie in Wahrheit auf einer Diskussion über Grundsatzfragen und nicht auf reiner Tatsachenüberprüfung beruht. Trotz ihrer Vielfalt haben alle Beiträge zwei Aspekte gemeinsam: einerseits teilen sie die Überzeugung der Notwendigkeit eines Dialogs zwischen so verschiedenen Disziplinen wie der Philosophie und dem Recht, um die zentrale Frage nach dem Bestehen von vor-positiven Elementen des Rechts aufzuklären, die jeder positiven Gesetzgebung vorangehen; andererseits sind sie der Überzeugung, dass solche Elemente ihre eigene Verständlichkeit haben. This volume contains the proceedings of a conference organized in May 2015 by the Instituto Cultura y Sociedad (University of Navarra). The scope of this conference was very wide as is proved by the variety of the contributions. They deal with such topics as the relationships between material value ethics and the idea of natural law, the distinction between the moral sphere and the sphere of law, the criticisms of those theories which ground human rights in natural law, the motives which lead us to consider certain facts and duties as consequences of social acts, the meaning of “freedom” in criminal law or the critical exam of such views which try to reduce the Philosophy of Law to some psychological, social or historical questions. However, despite their diversity, the contributions share two elements: on the one hand, the emphasis of the necessity of a dialogue between such different disciplines as Philosophy and Law focusing on a central question, namely, the existence of pre-positive elements, prior to every positive legislation and, on the other hand, the conviction that such elements have an own intelligibility.

The comparison of cultural transfer processes by means of literary production from and about the Caribbean, embedded in a broader context of the circulation of culture and knowledge deciphers the different transculturations of European discourses in the colonies as well as the repercussions of these transculturations on the motherland’s ideas of the colonial other: The loss of a culturally binding centre in the case of the Spanish colonies – in contrast to France’s strong presence and binding force – is accompanied by a multirelationality which increasingly shapes hispanophone Caribbean literature and promotes the pursuit for political independence. The book provides necessary revision to the idea that the 19th-century Caribbean can only be understood as an outpost of the European metropolises. Examining the kaleidoscope of the colonial Caribbean opens new insights into the early processes of cultural globalisation and questions our established concept of a genuine western modernity. While the very notion of a natural law has proved highly controversial among 20th Century scholars, the last decades have witnessed a renewed interest in it. Todd Lowry and Barry Gordon (Leiden: Brill, 1998), pp. 503-561 suffers from serious citation problems and that in some cases the original sources are never mentioned at all. It goes without saying that Brill strongly disapproves of such practices, which represent a serious breach of publication integrity. Brill condemns any violation of the authors' rights and the copyrights of the publishers, and distances itself from these practices. As a result Brill cannot stand behind the noted material as originally contained in this volume and for these reasons formally retracts the article by Francisco Gómez Camacho and also the volume. The volume will no longer be available in its current form. The renown of the poet was flimsier and more ephermal than that of Spain's most notable woman writer. It contained more enthusiasm and less respect. Most of his prose works and many of his dramas died young, whereas Dõna Emilia's infinitely more copious production was uniformly living and vigorous . The integral value of Pardo-Bazán's work is beyond measure greater than that of Campoamor. Whereas the novelist deserves a splendid rehabilitation, the modicum of praise still accorded to the poet perhaps exceeds his merits. Apart from a few flashes of genius—to be found in his prose works—Campoamor is intelligently ordinary. This characteristic incidentally makes him most valuable for this study. Campoamor offers a triple advantage as a lens through which to inspect the Spain of his day. Although he is now considered as a poet, his prose work, buried in oblivion—this is the first study to give it real attention—completes the authors' picture of him as a man who incorporated, in an admittedly ephermal way, all the spiritual and intellectual currents of his epoch: above all, the old religious traditionalism and the conflicting new scientific positivism. That Campoamor represented the feelings and the thoughts of the Spain of his time is proved by the enthusiastic applause with which his fellow-countrymen greeted his works. Finally, without being impeccably well-informed, Campoamor was deeply interested in the history and affairs of the world at large, and constantly strove to allot to Spain its correct place in his Weltanschauung.

Book excerpt: Women, Mysticism, and Hysteria in Fin-de-Siècle Spain argues that the reinterpretation of female mysticism as hysteria and nymphomania in late nineteenth- and early twentieth-century Spain was part of a larger project to suppress the growing female emancipation movement by sexualizing the female subject. This archival-historical work highlights the phenomenon in medical, social, and literary texts of the time, illustrating that despite many liberals' hostility toward the Church, secular doctors and intellectuals employed strikingly similar paradigms to those through which the early modern Spanish Church castigated female mysticism as demonic possession. Author Jennifer Smith also directs modern historians to the writings of Emilia Pardo Bazán (1851-1921) as a thinker whose work points out mysticism's subversive potential in terms of the patriarchal order. Pardo Bazán, unlike her male counterparts, rejected the hysteria diagnosis and promoted mysticism as a path for women's personal development and self-realization.

Book excerpt: Spanish physicians constituted a crucial political force in the nineteenth century during the tumultuous process of nation-building that followed the War of Independence against the Napoleonic invasion of the Iberian Peninsula. Many participated in the Cortes of Cádiz, which drafted Spain’s first constitution in 1812 and went on to prove highly influential in the public sphere and legislature during the liberal revolution that undertook the establishment of a new, and precarious, political order. Andrew W. Keitt’s A Physician in the Age of Liberal Reform excavates the life and work of one such doctor, Ildefonso Martínez y Fernández, whose brief career coincided with the consolidation of the liberal revolution and the drive to improve and professionalize Spanish medicine. Born in 1821, Martínez was a polymath and activist whose prolific literary and scholarly output made him a fixture in the political and intellectual ferment of midcentury Spain until his untimely death in 1855 during a devastating outbreak of cholera. He produced a significant body of intellectual research, made key contributions to the profession, and cultivated a deep engagement with the political struggles of the period. His impassioned endeavors, as chronicled by Keitt, highlight the efforts of Spanish physicians to mobilize medical science toward forging a new political culture for liberal Spain.

He was above all a patriot of his beloved Mexico, and he sought to deliver his humanitarian message to his countrymen. In his youth, after the revolt against Díaz, he was a member of the Ateneo de la Juventud, a group that sought to bring Mexico, spiritually and economically, back to the Mexicans. Caso realized that this effort involved the forming of a national consciousness among his people, whom he saw divided by their private and public interests. As an educator of Mexican youth for more than thirty years, Caso sought to imbue in his students the desire to search and to question. He saw education as a perpetual search for truth, and his own life and philosophy reflect this search. He rejected any system that proposed to describe all of reality, and he despised all dogmas—official or unofficial. He particularly fought against positivism and Marxism, systems current in his youth. The first part of this book is an introduction to the philosophical and educational ideas of Caso, as well as to the intellectual and political ideas in his life. Mr. Haddox skillfully shows the development of Caso's ideas and how they took shape from his own reading as well as from the experiences of his age and of his country. The second part contains Mr. Haddox's translations of selections from Caso's writings. They give a moving picture of Caso's hopes for Mexico and for humanitiy.
