No. 110-315, mandated GAO to study the financial and compliance audits and reviews required or conducted for the Federal Family Education Loan (FFEL) program and the Federal Direct Student Loan (DL) program. The Department of Educations (Education) Office of Federal Student Aid is responsible for administering these programs. This report focuses on(1) identifying differences and similarities in audit requirements and oversight procedures for the FFEL and DL programs, including anticipated changes to selected oversight activities and(2) describing how the Office of Federal Student Aids policies and procedures are designed to monitor audits and reviews. To do so, GAO interviewed Education and inspector general officials and reviewed numerous audit guides, agency procedures, checklists, and audit tracking systems.

GAO was asked to analyze Education's use of its oversight, guidance, and enforcement authorities under FFELP. To do this, GAO reviewed departmental documents and federal laws, regulations, and cases and interviewed officials from Education and the student loan industry. GAO recommends that the Secretary of Education: (1) update the department's oversight mechanisms to proactively identify possible instances of improper inducements and limitations on borrower choice; (2) be more proactive in investigating situations involving possible instances of these prohibited activities; (3) issue new guidance regarding inducements to guide the student loan industry until the relevant proposed regulations are finalized and become effective; and (4) develop a protocol to determine the appropriate level of response for cases of non-compliance and assess the effectiveness of these actions to inform and improve this protocol. Education agreed with the first two recommendations but did not explicitly agree or disagree with the other two. The following are appended: (1) Briefing Slides; (2) Scope and Methodology; (3) Comments from the Department of Education; and (4) GAO Contact and Staff Acknowledgments. Loan rehabilitation was established as an option to help Education collect defaulted student loans, and borrowers address the adverse consequences of default, such as repairing damaged credit. GAO was asked to review Education's loan rehabilitation process. This report examines how: (1) Education assists borrowers in rehabilitating defaulted student loans; (2) the upgrade of its defaulted loan information system affected loan rehabilitation; and (3) Education oversees private collection agencies in implementing loan rehabilitation. GAO reviewed Education's policies, procedures and guidance; contracts and monitoring records for the defaulted loan information system contractor and 22 collection agencies; collections and rehabilitation data; and relevant federal laws and regulations. GAO interviewed Education officials, representatives of borrower advocacy groups, and visited 6 selected collection agencies, based on their loan volume and geographic location. "

Book excerpt: This report of the Panel on Quality Improvement in Student Financial Aid Programs examines the quality control of federal student financial aid programs covered by Title IV of the Higher Education Act of 1965 and offers recommendations calling for sweeping revisions of the present system. The report explores: (1) the quality control practices employed by the Department of Education to measure the accuracy of eligibility of students for awards; and (2) the methods used by program managers, based on this information, to reduce errors. Part 1 describes the new philosophy of continuous improvement as well as Title IV student financial aid programs and the system for distributing the awards. Part 2 discusses the outcome of Department of Education activities to control, improve, and monitor the "quality of the award" in the current system. Among the topics addressed are the methodological and statistical integrity of current quality control studies, including the accuracy of estimates of national error rates; a review of the application forms and their instructions; and the potential for risk-based management of audit and review processes. Part 3 looks at the larger picture and recommends changes in the system that should more efficiently reduce the recurring problems identified in Part 2.
