He does not ask whether the federal court has interpreted the law correctly or not, but whether or not she ever consented that congress should pass the law. If congress had such power, he has no relief, for the decision of the highest federal court is final; if congress had not such power, then he is oppressed by the action of a usurped authority, and has a right to look to his own State for redress. His State may interpose in his favor or not, as she may think proper. If she does not, then there is an end of the matter; if she does, then it is no longer a judicial question. The question is then between new parties, who are not bound by the former decision; between a sovereign State and its own agent; between a State and the United States. As between these parties the federal tribunals have no jurisdiction, there is no longer a common umpire to whom the controversy can be referred. The State must of *necessity judge for itself, by virtue of that inherent, L J sovereign power and authority, which, as to this matter, it has never surrendered to any other tribunal. Its decision, whatever it may be, is binding upon itself and upon its own people, and no farther. A great variety of cases are possible, some of which are not unlikely to arise, involving the true construction of the Federal Constitution, but which could not possibly be presented to the courts, in a form proper for their decision. The following are examples. By the 4th section of the 4th article it is provided that "Congress shall guaranty to every State in the Union a republican form of government." What is a republican form of government, and how shall the question be decided? In its very nature, it is a political, and not a judicial question, and it is not easy to...

New York: Columbia University Press, 1952. 400 pp. Reprinted 1999 by The Lawbook Exchange, Ltd. LCCN 98-45409. ISBN 1-886363-66-8. Cloth. $95. * A thorough survey and examination of the "formal commentaries" on the Constitution that were written as summaries of official pronouncements by proponents of the two major schools of constitutional interpretation before the Civil War--the nationalist Northern school as evidenced by the Marshall-Story decisions in the Supreme Court, and the Southern states rights advocates who lacked an equal spokesman. As this important study places the commentaries in a historical context by comparing their theories, examining their impact and their roots in the lives of the authors, it serves to illustrate "the early divergence between the North and South in theoretical discussions of the nature of the Union, and eventually lead to the constitutional justification of Southern secession." From the Preface.

Available in PDF, EPUB and Kindle. Book excerpt: Far from a monolithic block of diehard slave states, the South in the eight decades before the Civil War was, in William Freehling's words, "a world so lushly various as to be a storyteller's dream." It was a world where Deep South cotton planters clashed with South Carolina rice growers, where the egalitarian spirit sweeping the North seeped down through border states already uncertain about slavery, where even sections of the same state (for instance, coastal and mountain Virginia) divided bitterly on key issues. It was the world of Jefferson Davis, John C. Calhoun, Andrew Jackson, and Thomas Jefferson, and also of Gullah Jack, Nat Turner, and Frederick Douglass. Now, in the first volume of his long awaited, monumental study of the South's road to disunion, historian William Freehling offers a sweeping political and social history of the antebellum South from 1776 to 1854. All the dramatic events leading to secession are here: the Missouri Compromise, the Nullification Controversy, the Gag Rule ("the Pearl Harbor of the slavery controversy"), the Annexation of Texas, the Compromise of 1850, and the Kansas-Nebraska Act. Freehling vividly recounts each crisis, illuminating complex issues and sketching colorful portraits of major figures. Along the way, he reveals the surprising extent to which slavery influenced national politics before 1850, and he provides important reinterpretations of American republicanism, Jeffersonian states' rights, Jacksonian democracy, and the causes of the American Civil War. But for all Freehling's brilliant insight into American antebellum politics, Secessionists at Bay is at bottom the saga of the rich social tapestry of the pre-war South. He takes us to old Charleston, Natchez, and Nashville, to the big house of a typical plantation, and we feel anew the tensions between the slaveowner and his family, the poor whites and the planters, the established South and the newer South, and especially between the slave and his master, "Cuffee" and "Massa." Freehling brings the Old South back to life in all its color, cruelty, and diversity. It is a memorable portrait, certain to be a key analysis of this crucial era in American history.
