Available in PDF, EPUB and Kindle. Book excerpt: "The National Environmental Policy Act has grown more, not less, important in the decades since its enactment. No one knows more about NEPA than Lynton Caldwell. And no one has a clearer vision of its relevance to our future. Highly recommended." —David W. Orr, Oberlin College What has been achieved since the National Environmental Policy Act was passed in 1969? This book points out where and how NEPA has affected national environmental policy and where and why its intent has been frustrated. The roles of Congress, the President, and the courts in the implementation of NEPA are analyzed. Professor Caldwell also looks at the conflicted state of public opinion regarding the environment and conjectures as to what must be done in order to develop a coherent and sustained policy.

Download or read book Geographic Information Science and Public Participation written by Laxmi Ramasubramanian and published by Springer Science & Business Media. This book was released on 2010-01-23 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: Computer-mediated participation is at the crossroads. In the early heady days of the digital revolution, access to "high" technologies such as GIS promised the empowerment of marginalized communities by providing data and information that was previously hidden away from public view. To a great extent, this goal has been achieved at least in the U.S. and Western Europe – data about a range of government initiatives and raw data about different aspects of spatial planning such as land use, community facilities, property ownership are available a mouse-click away. Now, that we, the public, have access to information, are we able to make better plans for the future of our cities and regions? Are we more inclusive in our planning efforts? Are we able to foster collaborative governance structures mediated by digital technologies? In the book, these issues will be discussed using a three-part structure. The first part of the book will be theoretical – it will review the literature in the field, establish a framework to organize the literature and to link three different subject areas (participation and community development, GIS and other related technologies, and planning processes). The second part of the book will be a series of success stories, case studies that review actual situations where participatory planning using GIS has enabled community wellbeing and empowerment. These case studies will vary in scale and focus on different planning issues (planning broadly defined). The final part of the book will step back to review alternative scenarios for the future, exploring where we are headed, as the technologies we are using to plan rapidly change.

Download or read book Regulation and the Courts written by R. Shep Melnick and published by Brookings Institution Press. This book was released on 2010-12-01 with total page 417 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, federal courts have become increasingly aggressive in shaping regulatory policy, abandoning their traditional deference to bureaucratic expertise. This new judicial activism has been particular evident in the regulation of air pollution. R. Shep Melnick analyzes the effects a variety of court decisions have had on federal air pollution control policy and assesses the courts’ institutional capacity for policymaking in such a complex arena. In six cases studies of environmental programs or issues he examines the interplay among the courts, the Environmental Protection Agency, Congress, and the White House. The conventional wisdom is that the courts have improved environmental policymaking, but Melnick concludes that as a whole “the consequences of court action under the Clean Air Act are neither random nor beneficial.” He finds that “court action has encouraged legislators and administrators to establish goals without considering how they can be achieved,” widening the gap between promise and performance. The results, he charges, have been increased cynicism, serious inefficiencies and inequities, and a lack of rational debate. An analysis of the institutional characteristics of the judicial branch reveals how these problems have come about and why they are likely to afflict other programs as well as environmental regulation. The author proposes several reforms to improve the courts’ ability to handle regulatory cases.
