Book Future Proofing the Judiciary

Download or read book Future Proofing the Judiciary written by Brian Opeskin and published by Springer Nature. This book was released on 2022-01-01 with total page 325 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book reinvigorates the field of socio-legal inquiry examining the relationship between law and demography. Originally conceived as 'population law' in the 1960s following a growth in population and a use of law to temper population growth, this book takes a new approach by examining how population change can affect the legal system, rather than the converse. It analyses the impact of demographic change on the judicial system, with a geographic focus on Australian courts but with global insights and it raises questions about institutional structures. Through four case studies, it examines how demographic change impacts on the judicial system and how should the judicial system adapt to embody a greater preparedness for the demographic changes that lie ahead? It makes recommendations for reform and speaks to applied demographers, socio-legal scholars, and those interested in judicial institutions.

Book The Continuity of Legal Systems in Theory and Practice

Download or read book The Continuity of Legal Systems in Theory and Practice written by Benjamin Spagnolo and published by Bloomsbury Publishing. This book was released on 2015-10-22 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Continuity of Legal Systems in Theory and Practice examines a persistent and fascinating question about the continuity of legal systems: when is a legal system existing at one time the same legal system that exists at another time? The book's distinctive approach to this question is to combine abstract critical analysis of two of the most developed theories of legal systems, those of Hans Kelsen and Joseph Raz, with an evaluation of their capacity, in practice, to explain the facts, attitudes and normative standards for which they purport to account. That evaluation is undertaken by reference to Australian constitutional law and history, whose diverse and complex phenomena make it particularly apt for evaluating the theories' explanatory power. In testing whether the depiction of Australian law presented by each theory achieves an adequate 'fit' with historical facts, the book also contributes to the understanding of Australian law and legal systems between 1788 and 2001. By collating the relevant Australian materials systematically for the first time, it presents the case for reconceptualising the role of Imperial laws and institutions during the late nineteenth and early twentieth centuries, and clarifies the interrelationship between Colonial, State, Commonwealth and Imperial legal systems, both before and after Federation.

Book The International Survey of Family Law 1994

Download or read book The International Survey of Family Law 1994 written by Andrew Bainham and published by Martinus Nijhoff Publishers. This book was released on 1996-03-14 with total page 524 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "International Survey of Family Law," published on behalf of the International Society of Family Law, is the successor to the Annual Survey of Family Law'. It provides information, analysis and comment on recent developments in Family Law across the world on a country-by- country basis. The Survey is published annually and its subtitle reflects the calendar year surveyed. Where a country has been regularly surveyed each year, the developments discussed correspond to the year in question. If certain countries have not been surveyed for some years the contributions will usually attempt to cover the intervening period. This applies, for example, in the present volume to the contributions relating to China and Turkey. If countries are being covered for the first time, then more background information will be provided about the state of family law in the country in question. Examples in this volume are the contributions from Bulgaria and Malta.

Book The Oxford Handbook of Children and the Law

Download or read book The Oxford Handbook of Children and the Law written by James G. Dwyer and published by Oxford University Press, USA. This book was released on 2020 with total page 954 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Children and the Law presents cutting-edge scholarship on a broad range of topics covering the life course of humans from before birth to adulthood, by leading scholars in law, medicine, social work, sociology, education, and philosophy, and by practitioners in law and medicine. An international collection of authors presents and analyzes the law and science pertaining to reproduction; prenatal life (including fetal exposure to toxic substances and abortion); parentage (including biology-based rights, background checks on birth parents, adoption, the status of gamete donors, and surrogacy); infant development and vulnerability; child maltreatment (including corporal punishment and religious defences to abuse and neglect); child protection policy and systems; foster care; child custody disputes between parents or between parents and other caregivers; schooling (including financing, resegregation, religious expression in public schools, at-risk students, special education, regulation of private schools, and homeschooling); delinquency; minimum-age laws; and child advocacy. Most chapters follow a format wherein they first describe the most debated or dynamic issues in each topical area, then explain in depth the law and/or science pertaining to the author's particular focus, and finally offer arguments and recommendations as to law and policy in that area. The normative component aims to advance discussions and debates in vital areas of contemporary child welfare law and policy. The Handbook is an essential resource for scholars and professionals interested in the intersection of children and the law.
