Book excerpt: Abstract: Across Europe, the labour market participation of persons with disabilities remains lower than that of persons without a disability. Our research examines this disability employment gap, looking specifically at its variation by country and gender. Additionally, we test the influence of labour market policies - testing both the social investment perspective and the welfare scepticism perspective - on the size of the gap, in an effort to determine whether a more generous welfare state raises or lowers the employment rate of people with disabilities. Using the European Union Statistics on Income and Living Conditions (EU-SILC), we show that Southern European countries have the smallest disability employment gap. Whereas stricter employment protection legislation is found to be beneficial for people with disabilities on the labour market, other labour market policies specifically intended to benefit this group do not strongly affect their chances on the labour market. We use the European Union Statistics on Income and Living Conditions (EU-SILC) for 2011-2019. We find that educational attainment is a major factor determining the probability of employment among persons with disabilities. In particular, the employment effects of tertiary education are much larger among persons with disabilities than among non-disabled people: that is, having a disability is a greater disadvantage for less educated than for better educated people. We provide evidence that the endogeneity of educational attainment does not drive these findings. We also uncover substantial heterogeneity in the role of education between countries. In more developed countries, the employment status of persons with disabilities is generally less dependent on their educational attainment. Overall, we estimate that 20% of the disability employment gap in the 25-34 age group can be attributed to the gap in education between individuals with and without disabilities.

Book excerpt: Over the last three decades, a number of reforms have taken place in European social policy with an impact on the opportunities for persons with disabilities to be full and active members of society. The policy reforms have aimed to change the balance between citizens’ rights and duties and the opportunities to enjoy choice and autonomy, live in the community and participate in political decision-making processes of importance for one’s life. How do the reforms influence the opportunities to exercise Active Citizenship? This volume presents the findings from the first cross-national comparison of how persons with disabilities reflexively make their way through the world, pursuing their own interests and values. The volume considers how their experiences, views and aspirations regarding participation vary across Europe. Based on retrospective life-course interviews, the volume examines the scope for agency on the part of persons with disabilities, i.e. the extent to which men and women with disabilities are able to make choices and pursue lives they have reasons to value. Drawing on structuration theory and the capability approach, the volume investigates the opportunities for exercising Active Citizenship among men and women in nine European countries. The volume identifies the policy implications of a process-oriented and multi-dimensional approach to Active Citizenship in European disability policy. It will appeal to policymakers and policy officials, as well as to researchers and students of disability studies, comparative social policy, international disability law and qualitative research methods.

Book excerpt: This book defined a contemporary disability human rights approach for the field of employment. Based on an analysis of the newly-adopted UN Convention on the Rights of Persons with Disabilities and present-day interpretations of international and European human rights instruments, the book identifies four main requirements as characterizing the contemporary disability human rights approach on the labor market: 1) substantive equality founded on inclusive general structures, 2) a definition of disability which recognizes that disability results from the interaction between impairment and social structures and that all persons may, at one time or another, be disabled, 3) involvement of organizations of disabled persons in law and policy-making, and 4) a rights-based approach. It examines Danish and Swedish employment law and policy, as well as their compliance. In addition, EU law and policy is examined. The analysis and comparison of Danish and Swedish law and policy concentrates on four different areas of employment law and policy: disability equality, employers' obligations towards employees with disabilities and/or reduced working capacity, employment promotion for unemployed persons with disabilities, and income-replacement for persons with disabilities outside the labor market. The comparison shows that the main difference between Danish and Swedish disability employment law lies in the level of employers' obligations under employment protection law, as well as health and safety law. It is argued that this difference leads to more inclusive general structures on the labor market in Sweden and constitutes the main explanation for the extreme difference in employment rates for persons with disabilities and reduced working capacity in Denmark and Sweden.
