Book excerpt: The document abstracted contains the complete record of the hearing held by the House of Representatives Judiciary Committee's Subcommittee on Intellectual Property on May 14, 1992 regarding H.R. 4426. The bill sought to exclude copyright protection for certain legal compilations in the wake of the Eighth Circuit's decision in West Publishing v. Mead Data Central, 799 F.2d 1219 (8th Cir. 1986), cert. denied, 479 U.S. 1070 (1987), and the Supreme Court's decision in Feist Publications v. Rural Telephone, 499 U.S. 340 (1991).The author's testimony before the House Subcommittee appears beginning at page 33 of the hearing, his prepared statement at page 35, and his letter to the Chair of the Subcommittee at page 308.The two key issues that confronted the Subcommittee with respect to H.R. 4426 were:(1) Are page and section numbers, etc., which identify laws, regulations, judicial reports, and portions thereof, protectible at all under standard principles of copyright law?(2) Even if such identifying matter were otherwise protectible, should protection be withheld by Congress in order to enhance access to the public domain documents, e.g., opinions of the courts or statutes enacted by legislative bodies like Congress, to whose location the identifying matter refers?The author's answers to the Subcommittee were, respectively, “no” and “yes.”

Information hoarding businesses reign supreme, using intimidation, aggression, and force to maintain influence and control.
