Spécialement, en des temps où l'on s'ingénie à chahuter la propriété intellectuelle notamment dans les secteurs de haute technologie, le contrat, lui-même petit à petit redessiné depuis quelques années, est souvent employé comme une arme privilégiée pour entamer ce droit d'exception. Que l'on s'arrête sur la marque, le brevet où encore sur le dessin ou le modèle, force est de constater que la technique contractuelle est souvent utilisée pour aménager ce droit, voire, plus encore, pour le remettre en cause. Organisé par la Chaire Innovation et brevet de la Faculté de droit et science politique d'Aix-Marseille Université, le workshop qui s'est tenu le 23 septembre 2016 a permis de revenir sur ces problématiques et de donner la parole à différents spécialistes qui ont pu, tour à tour, observer combien la liberté contractuelle semble aujourd'hui encercler progressivement les droits de propriété intellectuelle qui, historiquement, ont toujours laissé fort peu de place à la volonté des parties.

Book excerpt: Les œuvres transformatives sont celles qui empruntent à une œuvre première et apportent à leur tour une création originale lui conférant une protection par le droit d'auteur. Elles évoquent une adaptation au cinéma, une compilation de musique, une traduction d'un livre... Puis s'est développé le web 2.0, offrant de nouveaux de moyens de création, de communication. Les pratiques transformatives se sont alors diversifiées, multipliées : on parle dorénavant de remix, de mash-up, de sampling. Le régime propre aux œuvres transformatives se complexifie, pour deux raisons principales. Tout d'abord, de nouveaux acteurs, tels que les utilisateurs et les intermédiaires, doivent être pris en compte par la loi. L'œuvre composite a été défini par la loi de 1957 dans un contexte où l'emprunt créatif était principalement réservé aux professionnels. Ce n'est plus le cas aujourd'hui, chacun est libre de reprendre, transformer puis partager des contenus sur internet. On parle de « créations-amateurs ». Ensuite, les œuvres transformatives représentent, depuis longtemps, un lieu de conflit de droit. D'un côté, le droit exclusif détenu par l'auteur de l'œuvre première, de l'autre, la protection de l'œuvre composite par le droit d'auteur, justifiée au nom de la liberté d'expression. Le juge s'efforce donc de trouver un juste équilibre entre droit d'auteur et liberté d'expression, notamment par le mécanisme des exceptions. Seulement, la révolution numérique a rendu les contours de ces exceptions floues, si bien que le régime ne semble plus adapté aux créations numériques. Doit-on adapter les dispositions actuelles aux nouvelles pratiques transformatives ? Doit-on consacrer une nouvelle exception, en s'inspirant des enseignements du droit comparé ? La question de la réception des œuvres transformatives mérite alors d'être éclairée, en raison de la dimension mondiale du phénomène largement favorisée par le numérique, reflétant ainsi une problématique générale à laquelle est confrontée aujourd'hui le droit d'auteur.

Book excerpt: Comme deux éléments qui ne peuvent coexister sans se nuire, les exceptions au droit d’auteur et les mesures techniques de protection sont dans un rapport d’opposition. On ne compte plus dans la littérature spécialisée le nombre d’articles dédiés à leur incompatibilité. Les exceptions au droit d’auteur sont des « dérogations légales » au monopole d’exploitation. Elles permettent d’écarter la mise en oeuvre du droit exclusif alors que les conditions d’application de ce dernier sont réunies. Les mesures techniques de protection sont destinées à empêcher les utilisations interdites par les titulaires de droits. La question est de savoir si ces dispositifs techniques peuvent restreindre l’exercice des exceptions au droit d’auteur. La réponse est positive puisque la directive 2001/29/CE du 22 mai 2001 interdit de contourner des mesures techniques quand bien même il s’agirait de mettre en oeuvre une dérogation au droit d’auteur. Cependant, l’instrument européen instaure un régime de sauvegarde en faveur de certaines exceptions. Aussi, le législateur français a créé une autorité administrative indépendante – la Haute Autorité pour la diffusion des oeuvres et la protection des droits sur Internet – chargée de garantir le bénéfice de ces exceptions. Il est permis de se demander si l’instauration d’un régime de sauvegarde n’est pas la reconnaissance implicite de la valeur impérative des dérogations au droit d’auteur. En tous les cas, cela donne à penser que les exceptions constituent bel et bien des intérêts juridiquement protégés susceptibles d’être portés devant l’autorité judiciaire contrairement à ce qu’a jugé la Cour de cassation.

A glimpse at the general judicial latitude generally afforded to parodies, satires, caricatures, and pastiches demonstrates the social and cultural value of this particular form of artistic expression. With the advent of technologies and the evolution of copyright legislation, creative endeavours in the form of parody gathered a new youth but became unlawful. While copyright law grants exclusive rights to right-holders, this right is not absolute. Legislation includes specific exceptions, which preclude right-holders from exercising their prerogatives in particular cases which foster creativity and cultural diversity within that society. The parody exception pertains to this ultimate objective by permitting users to reproduce copyright-protected materials for the purpose of parody. To understand the meaning and scope of the parody exception, this book examines and compares five jurisdictions which differ in their protection of parodies: France, Australia, Canada, the US and the United Kingdom. This book is concerned with finding an appropriate balance between the protection awarded to right-holders and the public interest. This is achieved by analysing the parody exception to the economic rights of right-holders, the preservation of moral rights and the interaction of the parody exception with contract law. As parodies constitute an artistic expression protected under the right to freedom of expression, this book also considers the influence of freedom of expression on the interpretation of this specific copyright exception. The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
