Drawing on the experience of the Brazilian federal courts since the transition to democracy, Judging Policy examines the judiciary's role in public policy debates. During a period of energetic policy reform, the high salience of many policies, combined with the conducive institutional structure of the judiciary, ensured that Brazilian courts would become an important institution at the heart of the policy process. The Brazilian case thus challenges the notion that Latin America's courts have been uniformly pliant or ineffectual, with little impact on politics and policy outcomes. Judging Policy also inserts the judiciary into the scholarly debate regarding the extent of presidential control of the policy process in Latin America's largest nation. By analyzing the full Brazilian federal court system—including not only the high court, but also trial and appellate courts—the book develops a framework with cross-national implications for understanding how courts may influence policy actors' political strategies and the distribution of power within political systems.

This book presents papers from the 30th International Conference on Legal Knowledge and Information Systems (JURIX 2017), held in Luxembourg City, Luxembourg, in December 2017. In the three decades since they began, the JURIX conferences have been held under the auspices of the Dutch Foundation for Legal Knowledge Based Systems, and have become a fully European conference series which addresses familiar topics and extends known techniques, as well as exploring newer topics such as question answering and the use of data mining and machine learning. Of the 42 submissions received for this edition, 12 have been selected for publication as full papers and 13 as short papers, with an acceptance rate of around 59%. Diverse techniques such as information retrieval and extraction, machine learning, semantic web, and network analysis were applied, among others, and textual sources include legal cases, bar examinations, and legislative/regulatory documents. The book will be of interest to all those working in the legal system who wish to keep abreast of the latest developments in information systems.

Despite the mixed racial background of most Brazilians, the state recognizes people’s racial classification according to a simple official scheme in which those self-assigned as black, together with “brown” and “indigenous” (preto-pardo-indigena), can qualify for specially allocated resources, most controversially quota places at public universities. Although this quota system has been somewhat successful, many other issues that disproportionately affect the country’s black population remain unresolved, and systemic policies to reduce structural inequality remain off the agenda. In The Prism of Race, David Lehmann explores, theoretically and practically, issues of race, the state, social movements, and civil society, and then goes beyond these themes to ask whether Brazilian politics will forever circumvent the severe problems facing the society by co-optation and by tinkering with unjust structures. Lehmann disrupts the paradigm of current scholarly thought on Brazil, placing affirmative action disputes in their political and class context, bringing back the concept of state corporatism, and questioning the strength and independence of Brazilian civil society.

Government responses to the COVID-19 pandemic differed vastly in terms of both the choice of strategies adopted (herd immunity, test-and-trace, lockdown, etc) and the quality and speed of government implementation of those strategies and associated interventions. Both factors impacted the number of infections and casualties. It is therefore appropriate to consider forms of criminal liability for failure of individual members of government, including specific public authorities, to act to the best of their abilities, as timely as possible, and in accordance with expert advice.
