The content of the book differs from the content of this paper and is not related to the questions posed in this research.1 Part II of this research gives a detailed overview of what security actually means in global politics and how key players understand it. General definitions and theory allows us to understand the major parts of this thesis (part III and IV). Part III describes different approaches to security in IR theory and explains it on the basis of European political integration. The historio-political analysis in this part shows the evolution of a CFSP and the ESDP. Institutionalization processes within the European Union explain the current status of the EU’s foreign policy, which is a status in process without having a clear and defined goal. This part includes the legal dimension of the EU’s foreign policy as well and describes the problematic situation Europeans currently have to face, namely disputes about the legal personality of the European Community and the European Union. It covers the evolution of European defence and security law in its legal,historical, and political context. The notion of defence law describes the entire field of rules created to regulate the defence of a nation or alliance. The analysis leads from the earliest mutual defence treaties to the failure of the European Defence Community and the eventual separation of defence from the mainstream of European integration in the 1950s, further to the re-vitalisation of a European security policy in the Treaties of Maastricht, Amsterdam, and Nice. In the context of this evolutionary process, the book examines the function of Community Law as an instrument of European defence integration. Community law affects the economic and social aspects of the defence within the limits of the security exemptions of the EC Treaty. It has an impact on the composition of the armed forces, the procurement of armaments, or the regulation of the defence industries. The book concludes with an analysis of the Common Security and Defence Policy of the Constitutional Treaty agreed by the European Council in 2004. The discussion shows that European defence integration is characterised by fragmentation in an area where coherence is particularly important. First, defence and security are addressed in several organisations: the EU, the Western European Union, NATO, the Organisation for Security and Cooperation in Europe, and the Organisation for Joint Armaments Cooperation. Second, defence and security are addressed in both the supranational Community Pillar and the intergovernmental Second Pillar of the Treaty on European Union. The new Constitutional Treaty aims to overcome the three-Pillar structure of the Union. Nevertheless, it leaves the intergovernmental character of the security and defence policy intact and introduces flexible frameworks for its mutual defence, crisis management, and armaments components. However, the Union needs a coherent defence policy to ensure her security and to speak with one voice on the international scene.

Regime complexes can be found wherever state interests clash. Thus, even in one of the most constitutionalized of institutional environments, the European Union (EU), regime complexity features prominently – especially in European defence cooperation, where states have created competing institutions overlapping in their mandates to organize armaments cooperation or defence planning. The tense relationship between the institutions of the EU’s Common Security and Defence Policy (CSDP) and those of NATO is well-known. Yet inter-institutional conflict is not limited to this dichotomy. It extends to institutions beyond these two frameworks, such as those of the former Western European Union and regional defence cooperation frameworks such as the Nordic Defence Cooperation (NORDEFCO), or OCCAR – a minilateral armaments agency. All these institutions have partially overlapping membership structures and mandates and therefore rival authority claims in the field of European defence. The European defence market is characterised by a mixture of inter-state competition and European cooperation, and this work assesses why countries sometimes decide to cooperate with their partners, while in other instances they refrain from doing so. In order to shed light on this empirical puzzle, the book focuses on state-defence industry relations in the four major European arms producers: France, Germany, Italy and the UK. The main argument is that the public or private governance of industrial suppliers and market size are the two decisive variables that explain the simultaneous presence of cooperation and competition in European defence procurement. Specifically, it argues that in public governance ecosystems, arms industries are able to "capture" the state's decision-making processes to their own advantage. In private governance ecosystems, the state is relatively autonomous from defence industry's influence and able to pursue larger macro-economic and military benefits. Moreover, the strategy pursued by governments and defence firms is decisively shaped by market size because of its importance in determining the relative costs and benefits of collaborative arrangements. This sudden burst of EU activity in the realm of external security is interesting from both a scholarly and a policy perspective. On one hand, institutionalised cooperation in the field of foreign, security and defence policy challenges the mainstream in IR theory which holds that in such sovereignty-sensitive areas cooperation would necessarily be limited. On the other hand, the sheer quantity of operations suggests that the ESDP may represent a potentially significant feature of global governance. In order to understand the drivers behind CSDP, EU Foreign Policy and Crisis Management Operations analyses the policy output in this area, including the operations conducted in the CSDP framework. Up until now, many studies inferred the logic behind CSDP from express intentions, institutional developments and (the potential of) pooled capabilities.
